GREELEY β€” A district judge this morning ruled that Weld County officials violated the privacy rights of the clients of a Greeley tax preparer's office and said their records could no longer be used in criminal cases.

Judge James Hiatt ordered that 5,000 tax records taken in an Oct. 17 raid must be returned or destroyed within seven days.

"There was little the public could gain from this search," said Hiatt.

Weld County District Attorney Ken Buck declined to comment after the ruling.

The county's investigation began last year when a Texas man alerted Weld County authorities that his identity was being used. Authorities zeroed in on Amalia's Translation and Tax Services and raided the business, taking thousands of documents to form their cases.

The Weld County Sheriff's Office and Buck allege that as many as 1,300 immigrants were filing tax returns using false or stolen identities. Dozens were arrested, and at least 60 cases were filed, with some defendants already pleading guilty to charges of identity theft and criminal impersonation.

But immigrant advocates say the people charged were doing nothing wrong, and the ACLU filed a lawsuit contending the seizure of thousands of documents from theGreeley tax preparer's office was illegal.
