Arrested Dec. 12, some workers remain in custody

Fifteen to 20 workers arrested Dec. 12 at the Swift & Co. meatpacking plant in Greeley remain in custody at the Immigration and Customs Enforcement detention facility in Aurora, said Christina Fiflis, a Boulder immigration attorney who has represented scores of Swift workers.
Most of the workers have been deported. Five are serving, or have completed, sentences for having false identifications.

• On the day of the raid, 83 workers from Mexico were immediately deported. About 60 were transferred to El Paso, Texas. The rest remained in ICE's Aurora detention facility.

• On Jan. 12, after learning that about 80 workers still had not received bond hearings, U.S. District Judge John Kane ordered the government to conduct the hearings within 48 hours. All the remaining workers received hearings. Fewer than 20 were charged in Weld County with crimes related to identity theft.

• On April 11, an additional 23 workers were released on bond that ranged from $2,000 to $5,000.

• On May 2, the court granted the release of 12 more workers, but ICE appealed that decision, Fiflis said. That same day, Weld County authorities dropped identity theft charges against eight of the illegal immigrants in return for their cooperation in a federal investigation.

• On Tuesday, the remaining two ID theft cases were dismissed.
