    PHOENIX — The American Civil Liberties Union has revamped its racial-profiling lawsuit against Maricopa County Sheriff Joe Arpaio, including adding an aide to Phoenix Mayor Phil Gordon as a plaintiff.
    The new version narrows the focus of the charges against Arpaio and his department to "sweeps" and other enforcement actions where motorists were stopped and questioned because of their skin color, said attorney David Bodney, who filed the revised lawsuit Wednesday in U.S. District Court.
    Bodney said he believes that will be easier to prove in court based on the number of victims.
    He said the new lawsuit asks simply for Judge Mary Murguia to ban the Sheriff's Department from engaging in race-based discrimination and to require the sheriff to put "safeguards" in place to prevent future problems.
    The first lawsuit, filed in December, had sought not only monetary damages on behalf of a discrimination victim but a court order to dissolve the sheriff's special immigration enforcement unit.
    Sheriff's Capt. Paul Chagolla said Arpaio would not comment on the litigation.
    One of the new allegations involves Jessica Rodriguez, whom Bodney identified as an aide to Mayor Gordon.
    According to the lawsuit, Rodriguez and her husband, David, had been visiting Bartlett Lake when they came across a sign that said "road damaged" ahead of a washed-out section. Two sheriff's vehicles were parked on opposite sides of the damaged area.
    Like other motorists, the Rodriguezes turned around and headed the other way before being pulled over. The lawsuit says the couple was asked for Social Security cards and other information; other motorists, all Anglos, were simply stopped and warned about the turn, the suit says.
    Other plaintiffs complained of being singled out for special treatment because of their race.
    Arpaio has been at the center of controversy because of his decision to saturate certain areas with deputies whose specific aim is looking for even minor traffic violations. Arpaio has justified the sweeps saying they result in the arrests of illegal immigrants and of people with outstanding arrest warrants.

    So now the ACLU is using American taxpayer funds to sue a law enforcement officer for enforcing the law?
    Personally, I don't mind being asked for license, insurance, or Social Security card, as long as it helps stop those who violate the laws. I wish they would go back to random license and insurance checks here in Texas. Too many people driving who should not be.

    Why isn't a lawsuit bought against the "Anit-Chirstian-league of -Communists ?" And they are deported, banned kicked out ? Our Constitution says nothing to authorize such Anti-American behaivor on our soil .

    The anglos probably had a real drivers license and were warned and sent on their way. The others who were most likely illegals probably had no drivers license and were asked for another form of id. When they couldn't provide one BINGO law enforcement knew they were most likely illegals. It doesn't take a rocket scientist to figure this one out.

    That's just great! if Judge Murguia has any judicial integrety (she may have an obligation to do so), she will recuse herself from this case due to of the perception of a bias or conflict of interest because her sisters affiliation with NCLR and their position on this issue. There doesn't have to be a direct conflict, just a perception that his/her impartiality may be reasonably questioned. I suggest the Judge brush up on 28 U.S.C. & 455
    (5)(iii) and make an honest assesment before she sits in on this case.

    Has the NCLR come out publically and made any comments or stated a position on what's happening in Arizona in regards to the sheriff and his efforts to apprehend illegals? I guess what it comes down to whether one may resonably believe the NCLR has an interest in the outcome of this case.

    This why we can never agree to another amnesty with the assurances of future enforcement and border security (i.e. the "comprehensive" approach). The OBL is fighting tooth and nail against the limited, belated enforcement that is going on now. It's not hard to imagine that once they received their beloved amnesty, the OBL would litigate, fight, and stall any future enforcement into oblivion.

    Moral of this story: NO more amnesties.

    You are so right . No Amnesty at ALL . In the history of the World it's never worked and it will not work now . They will not even Assimilate . A nation with 2 languages ? No way . Just look at Frances and Britons fight right now with Illegals . The Brits are so mad they where Suckered in to this mess . Let it NOT happen to us !!!

    That's what I wondered! This judge needs to removed from this case immediately!
