    (RTTNews) - Tuesday, in a regulatory filing American Apparel, Inc. (APP: News ) said, as previously disclosed, on January 3, 2008, representatives of U.S. Immigration and Customs Enforcement or ICE conducted an inspection at American Apparel to determine the company's compliance with the Immigration and Nationality Act. The Company cooperated in all respects with the inspection by ICE.

    On June 24, , ICE notified the Company that it was unable to verify the employment eligibility of approximately 200 current employees. Additionally, ICE notified the Company that another approximately 1,600 current employees appear not to be authorized to work in the United States. ICE's notification provided no indication that the Company knowingly or intentionally hired unauthorized aliens and no criminal charges have been filed against the Company or any current employees.

    Unless these employees are able to resolve the discrepancies in their work records, such employees will not be able to continue their employment at the Company. At the present time, the Company is not able to accurately assess what the resultant impact of the loss of employees would have on its operations.

    However, even if the Company were to lose substantially all of the 1,800 identified employees in its manufacturing operations in the Los Angeles area, the Company does not presently believe that the loss of employees would have a materially adverse impact on its financial results.

    No indication the company "intentionally or knowlingly" hired illegal invaders! I guess the Legalize LA" slogan on billboards and T-shirts was nothing more than political statement. I suppose the commercials they run on spanish tv, advertising positions in their downtown LA sweatshop are innocent recruting ads. But of course this company never "intended" to hire illegal invaders.

    Whatever! I have been wondering when ICE was going to do a raid on this company! What's the likelihood any of these illegal invaders are going to be deported! Is this the new Homeland Security protocol whereby they now go after the companies, but ignore the illegals found working?

    In the same spirit as this memo, are we to assume ICE also found no indication that the illegal invaders uncovered, intentionally or knowingly applied for work using fradulent or stolen identifications?

    How wonderful "The Company" cooperated in all respects with the inspection by ICE. Too bad they did not obey the law in "all aspects" prior to ICE knocking on the door! I would hope E-Verify would be made mandatory for companies like American Apparel who have been found by ICE to have illegal invaders on their pay rolls!
