    AZ Employer Law Hearing Results

    Judge says he's not inclined to block AZ employer sanctions law

    "PHOENIX -- A federal judge says he's leaning against temporarily blocking enforcement of Arizona's new law penalizing businesses that employ illegal immigrants.

    U.S. District Judge Neil Wake told lawyers in the case Tuesday that he's inclined to turn down a request from business groups for a temporary restraining order.

    Wake says he plans to rule by the end of the week, and one of the lawyers for the challengers says they'll appeal a denial.

    Wake also expressed a belief that he must consider the interests of the public on whether to delay the law.

    He specifically cited the interests of law-abiding workers who are harmed by competition from unauthorized workers.

    Under the law, violators caught knowingly employing illegal immigrants would have their business licenses suspended for up to 10 days. A second offense would lead to permanent revocation."

    I think this is the way to address these matters...citizens and legal permanent residents should be suing employers, cities, states and the federal government for allowing illegal aliens to usurp the working rights of lawful workers in the U.S. Those here unlawfully are jamming the courts with cases claiming they're being wronged by measures aimed at curbing illegal immigration where it should be citizens and lawful U.S. residents suing because their rights are being circumvented and trappled upon when illegal aliens are allowed to take jobs and benefits from U.S. citizens and legal permanent residents.

    Legal Arizona Workers Act
    Immigrant groups and business alliances are trying to stop the countdown clock to employer sanctions. The law would suspend state licenses of businesses that employ illegal immigrants after January 1, 2008.

    The groups asked a federal judge for a temporary restraining order Tuesday. It's part of a lawsuit against State of Arizona and all the county attorneys, saying the sanctions overstep the Arizona's constitutional boundaries. Plaintiff's attorneys argue the state should not require businesses to use the E-Verify employment system, which the federal government created as a voluntary way to check applicants' work status.

    Judge Neil Wake seemed inclined to leave the employee sanctions law in place. He said he didn't want to confuse employers about the law's effective date, and he expressed concern for legal workers who have difficulty finding good-paying jobs.

    In court, the county attorneys agreed that they won't take their first employer sanctions cases to court until at least February. That leaves time for more federal court wrangling.

    Judge Wake will make an official ruling on the temporary restraining order later this week. He will also hold a preliminary injunction hearing on January 16th.
