Judge rules that immigrants granted deferred deportation status can get in-state tuition

PHOENIX – A judge says young immigrants granted deferred deportation status by the Obama administration are eligible for in-state college tuition.
Tuesday's ruling from Maricopa County Superior Court Judge Arthur Anderson comes in a lawsuit filed by former Attorney General Tom Horne against the Maricopa County Community College District.
Horne contended that so-called "dreamers" offered deferred action status were not legally present in the U.S and could not get state benefits because of a 2006 voter-enacted law known as Proposition 300.
But Anderson says the federal government considers deferred action recipients lawfully in the U.S. and they can get lower in-state tuition.
President Barack Obama created the Deferred Action for Childhood Arrivals program in 2012 for young people who had been brought to the United States illegally as children.

The federal government, Congress, Supreme Court, and our laws do not consider DACA amnesty recipients to be here legally... only the Obama administration does!

Arizona officials grant in-state tuition to young immigrants protected from deportation

PHOENIX – The board overseeing Arizona's three public universities has voted to grant in-state tuition to young immigrants who were granted deferred deportation status by the Obama administration.
The decision Thursday by the Arizona Board of Regents came after a Maricopa County judge ruled that the immigrants were eligible for cheaper in-state tuition.
In 2013, then-Arizona Attorney General Tom Horne filed a lawsuit that alleged metro Phoenix's community college system violated the law by determining immigrants who received work-eligibility documents as part of the Obama policy were eligible for in-state tuition rate.
The system had denied violating the law and argued that the students' presence in the country is legal while they participate in Obama's program.
Regents say they are committed to providing affordable access to higher education for all eligible students.
