Round 1: Lawmen face off with feds

Barack Obama and Eric Holder may be relishing their power, but they're in for a good, old-fashioned American pushback. I can't wait.

Two names to remember: Larry Dever and Paul Babeu.

Earth to Obama: It's an "old-fashioned American pushback" – not an international reaction. I hope you know the difference.

The man who is president and the man who is attorney general have decided that Arizona doesn't have the right to protect itself and its citizens.

They've dug in their heels and are using the courts to prevent Arizona from defending itself against a massive flood of illegal aliens across its border.

That's a fancy way of saying the federal government is suing Arizona to prevent it from enforcing the new law, S.B.1070, that says it's illegal for an illegal alien to be in the state.

The law gives police the right, after a legal stop, to inquire about the suspect's immigration status if there's reasonable suspicion. The law becomes effective July 29.

The feds sued, but they didn't count on the independence and spirit of self-preservation that's part of the DNA of westerners – people who live close to the land, appreciate it and will fight with every fiber of their existence to protect it.

That's exactly what two Arizona sheriffs are doing. They're not taking the legal assault on their state and law enforcement lying down. They're getting into the fray and fighting back in Obama/Holder territory – the courts.

Cochise County Sheriff Larry Dever and Pinal County Sheriff Paul Babeu announced Thursday, in Phoenix, the formation of Arizona "Border Sheriffs" – a legal defense fund to defend deputies sued for enforcing Arizona's immigration law.

Dever told me Arizona "Border Sheriffs" will make it possible for officers to defend themselves without relying on taxpayer money. He said the fund will be managed by the Legacy Foundation, an Iowa non-profit, which says donations are coming in from across the country.

Both men are personally named in a lawsuit filed by the ACLU, and both face legal threats by the feds – essentially facing legal action for enforcing the law and doing their job.

What's not understood is that every sheriff and county attorney in Arizona is also named in the lawsuits.

Babeu had hired an outside attorney, as has Dever, who told me they needed a more vigorous defense than they would get from the county attorneys who tend to question the constitutionality of the new law.

The fed's lawsuit says immigration is a federal responsibility. In that case, Babeu said, the president should do his job. He says it's outrageous – that government should be helping them, not suing them.

It doesn't take a Harvard scholar to see the stupidity of the Obama/Holder position on illegals.

If a person is in the country illegally, commonsense says, it would also be illegal to be in any one of the 50 states – because those 50 comprise the country.

You can't be in the country without being in one of the states, unless you're talking about our territories – and we're not!

Polls show 60 to 80 percent of Americans support Arizona's law, yet Obama and Holder ignore that.

Apparently, for a Harvard scholar, common sense isn't a given.

Obama and Holder prefer to pander to the illegal-immigration faction and are proceeding with the lawsuit.

In addition, there are at least six other lawsuits against Arizona by "pro-illegal" groups.

The very thought boggles the mind.

But there's pushback. Rhode Island has a similar law on the books; four other states are considering such legislation and at least 20 others are planning similar laws.

Arizona and the "Border Sheriffs" aren't alone. Michigan Attorney General Mike Cox last week filed a brief supporting Arizona's law. He's joined by Alabama, Florida, Nebraska, Pennsylvania, South Carolina, South Dakota, Texas, Virginia and the Northern Mariana Islands.

Dever told me they got a big boost last week from Sen. John McCain, R-Ariz., who, when he heard about bordersheriffs.com, pledged $5,000 to the defense fund.

The flood of illegals across Arizona isn't new. Millions have crossed the borders over decades, and it continues to this very minute. No one knows how many are here, where they are or even, who they are.

Obama talks about 11 million illegals.

He has no idea what he's talking about.

Anyone with a modicum of common sense can see the numbers from the states, the Border Patrol, law enforcement, schools, hospitals and jails across the country and know the total is much higher.

But politics doesn't let common sense get in the way of a mind made up.

When illegal aliens – Mexicans, and the rest, from almost every country around the world – pour across the U.S. border, spread across the country and live illegally, they're sucking tax dollars from Americans. When they work, using fake IDs, they rip off the system. When they steal IDs, they rip off the people.

The idiocy of this is crystallized in the words of two top administration officials. First: John Morton, director of ICE, the agency charged with enforcing immigration laws, said that states shouldn't have such laws because it's the feds' job to eliminate illegals from the country.

He didn't say why they don't.

Second: Janet Napolitano, secretary of Homeland Security and former Arizona governor. Sheriff Larry Dever told me he saw her on TV discussing the illegal problem and she said she wished someone would explain to her what border security means!

Dever calls that "fundamentally very, very bad."

I'll modify that. It's bad, dangerous and deliberate, and it's time for Janet, along with other top administration officials to resign, be fired, or be thrown out of office before they totally destroy this country.
