Agent to ask for new location for trial

A Border Patrol agent charged with fatally shooting an illegal immigrant from Mexico plans to ask that his retrial be moved out of Tucson.

Agent Nicholas Corbett was charged with second-degree murder, manslaughter and negligent homicide in the January 2007 death of 22-year-old Francisco Javier Dominguez Rivera of Puebla, Mexico.

His first trial was declared a mistrial in March because the jury was deadlocked. The new trial is set for Sept. 9 in Tucson.

Jim Calle, an attorney for Corbett, filed a request with the court for permission to file a non-electronic exhibit with a motion for change of venue.

It's not clear when or where the new trial would be held if the judge agrees to move it elsewhere. Calle declined to comment on his request.
