U.S. Border Patrol agent fired upon a suspect encountered along the Rio Grande for the second time in less than a month Wednesday night, the agency confirmed.

In both instances, the agents involved feared for their physical safety, according to Border Patrol. Agency spokesman Henry Mendiola said the agent fired his gun in an area near the Rio Grande City port of entry, striking one man in the arm, shortly after 7 p.m. Wednesday.

The injured man, who drove the suspect vehicle involved, was taken to a local hospital for treatment. He is believed to be an undocumented immigrant.

Mendiola said the agent, who was alone and on foot, saw a car suspected of carrying contraband pulling away from the Rio Grande. The driver saw the agent and then drove towards him, Mendiola said.

“The driver swerved into our agent and attempted to hit him with the vehicle,” Mendiola said, adding it was not immediately clear how many shots were fired.

The agent was able to get out of the way of the car and was not injured.

“He feared for his life and he shot in self-defense,” Mendiola said.

The driver was immediately arrested when the car came to a stop. No drugs were found inside, but three undocumented immigrant passengers were detained, Mendiola said.

Authorities believe the case involves human smuggling.

A shooting under reportedly similar circumstances happened Dec. 12 south of the town of Abram, west of Palmview.

Border Patrol said an agent fired his gun when his partner was hit by a suspect’s car near the Rio Grande.

The agent who was struck had minor injuries to his leg, but it was unclear whether the suspect who drove the car was hurt because he crossed the river back into Mexico, the agency said.

Border Patrol did not find contraband in the car driven by the suspect.
