MISSION — Federal agents have detained a Guatemalan man for stabbing a Border Patrol service dog — a 2-year-old German shepherd — Sunday morning near Mission.
At 5:30 a.m. on Sunday, Border Patrol agents arrested 30 people near the monastery south of Mission, according to a statement from the U.S. Border Patrol’s Rio Grande Valley Sector. During the operation, the female German shepherd was stabbed in the neck.
Agents quickly administered first aid and rushed the dog to a veterinary hospital for emergency surgery.
“The dog was stabbed in the neck, right above the shoulder blades,” said agency spokesman Enrique Mendiola.
The two-inch-deep stab wound damaged muscle and skin tissue, but the German shepherd emerged from surgery in good condition, according to the Border Patrol statement.
Agents detained a Guatemalan man and recovered an unspecified weapon from the scene. The FBI has launched an investigation, according to the Border Patrol statement.
Under federal law, maliciously harming any police animal is punishable by a fine and up to a year in prison.
“Fortunately, it wasn't life threatening,” Mendiola said. “And she’ll be coming back to work in a week or so.”

McALLEN — A Guatemalan immigrant went before a federal judge Tuesday to face charges of harming a police animal and illegal reentry.

Luis Gilberto Cruz Solis went before U.S. Magistrate Judge Peter Ormsby, who ordered he remain in custody without bond ahead of a detention hearing later this week.

Cruz is accused of stabbing in the neck "Dinie," a U.S Border Patrol K-9 as it chased him Sunday morning near Mission, court records show.

Several Border Patrol agents conducting line watch spotted a group of 30 immigrants running into an orchard. Dinie and his handler ran into the brush area chasing Cruz who had split up from the group.

Once Cruz was in custody, the dog handler used a flashlight to discover that Dinie’s harness was covered in blood.
The dog was rushed to a veterinary hospital, where she was treated for a 2-inch deep stab wound to the right side of her neck. The dog is expected to recover from the wound.

Cruz told agents he was running away from Dinie, but he fell and was bitten by her. That is when he used a knife to stab the dog and then threw it out into the brush, court records show. Border Patrol agents were able to recover the knife.

Stabbed Border Patrol dog ready to work

    POSTED: Tuesday, May 14, 2013 - 4:52pm

    UPDATED: Wednesday, May 15, 2013 - 8:51am

Edinburg, TX (KVEO NEWS CENTER 23) — A Border Patrol canine is recovering and resting after a stabbing.

A 2.5 year old German shepard had a two inch stab wound in the back of her neck. The incident happened during an arrest on Sunday.

But after surgery, she's doing better and will be back on the front lines in a few days.

"These dogs, until you actually physically stop them, they're going to continue to go," said Border Patrol officer Henry Mendiola, who declined to give the dog's name. "When the handler picked her up at the vet after the surgery, she's already up and running, but obviously the handler knows best."

The suspect who stabbed her is behind bars for illegal entry into the country and harming a service animal.

McALLEN — A 19-year-old Guatemalan national pleaded guilty Wednesday to stabbing a U.S. Border Patrol dog earlier this month.
In federal court Wednesday, Luis Gilberto Cruz-Solis entered a guilty plea for willfully and maliciously harming a police animal and entering the country illegally, according to statement from Angela Dodge, a spokeswoman for the U.S. attorney for the Southern District of Texas.
About 4:30 a.m. May 12, a Border Patrol agent and his K-9, Dinie, reported to a Mission-area orchard where approximately 30 people suspected of illegal immigration had been seen running, according to court documents.
One of the immigrants, later identified as Cruz-Solis, jumped up from the brush and began running. Dinie and her handler — identified in court documents only as “W.D.” — chased Cruz-Solis through the brush. Dinie ran ahead of W.D., then returned and led him to Cruz-Solis, whom he found lying on the ground with his hands in the air.
After finding Cruz-Solis, W.D. discovered Dinie’s harness was covered with blood, and then found a stab wound on the right side of her neck, court documents said. The wound was 3/4 inch wide and 2 inches deep, but did not cause any damage to Dinie’s bones, tendons or ligaments.
Cruz-Solis told Border Patrol agents that he fell while Dinie chased him. The dog bit him, and then he stabbed it before throwing his knife into the woods, he said. Border Patrol agents found the knife Cruz-Solis used, and he admitted it was the one he used to stab the dog.
Dinie made a full recovery and returned to work Sunday, Border Patrol spokesman Danny Tirado said.
Cruz-Solis is scheduled for sentencing June 5 and could face up to one year in federal prison and a $100,000 fine. After serving his sentence, he will face deportation hearings.
