Border Patrol shooting investigation in the South Bay

Border Patrol agents and San Diego police are investigating a fatal officer-involved shooting involving a Border Patrol agent this evening on Leon Avenue near Hollister Street in the Nestor neighborhood of San Diego, authorities said.

San Diego police homicide detectives have been sent to investigate the shooting.

Border Patrol agents in law enforcement vehicles can be seen blocking Leon Avenue at Hollister Street at this hour. Although it is near a residential area, Leon Avenue is poorly lighted and dark.

We will provide more information as it becomes available.

Border Agent shoots pickup truck driver near border
By Angelica Martinez and Jose Luis Jiménez

    9:29 p.m. September 16, 2009

SAN DIEGO – At least one Border Patrol agent shot the driver of a pickup as it tried to run over agents who were detaining two suspected illegal immigrants near the U.S.-Mexico border Wednesday evening, authorities said.

The man driving the truck was later detained in the Nestor neighborhood and taken to a hospital for treatment, said supervisory Agent Daryl Reed, a Border Patrol spokesman. He did not know where or how many times the man was shot.

About 6:30 p.m., agents were stopping two people at the entrance to Smuggler's Gulch near Monument Road in the Tijuana River Valley. At some point, a Ford F-150 drove toward the agents on Monument Road in an apparent attempt to run them over, Reed said.

At least one agent opened fire, and the truck drove north on Hollister Street, the spokesman said.

The man made a left turn on Tocayo Avenue and then a right turn on Gayo Court, which is a cul-de-sac with homes, Reed said. He left the truck and ran through several yards.

Agents went to Leon Avenue, where they detained the suspect, Reed said. No Border Patrol agents were hurt.

A resident where the suspect was arrested was reading in her garage when she heard a loud, thumping noise. She said she instinctively got up and locked the side door to the garage moments before someone tried to force the door open.

The resident then ran to lock the rest of the doors in the home when she saw Border Patrol agents jump into her yard, asking if she saw anybody running. She pointed them to the front yard, where agents took a man into custody. He was later taken away in a gurney, said the resident, who asked not to be identified because she feared for her safety.

Moments later, the neighborhood was swarming with more Border Patrol agents, San Diego police officers and helicopters, she said.

San Diego homicide detectives are investigating the shooting, along with the FBI, which normally investigates shootings involving Border Patrol agents, Reed said.

Wednesday's shooting was the latest in what some are calling an increase in violence along the border.

One of the most violent examples was the shooting death of U.S. Border Patrol Agent Robert Rosas. The 30-year-old was shot eight times July 23 about 30 yards from the border in Campo while investigating a report of suspicious activity. The assailants squeezed back into Mexico through an opening beneath the fence, vanishing in the dark.

Rosas' death prompted stepped-up patrols in both countries. On Aug. 17, the Border Patrol's San Diego sector launched Operation Stronghold, increasing agents and operations in the area.

Staff writer David Ogul contributed to this report.

JUST GOES TO SHOW THAT YOU GET WHAT YOU ASK FOR THESE PEOPLE ARE BOUND AND DETERMINED THAT THEY ARE GOING TO HAVE THINGS THEIR WAY. BUT, THIS IS NOT BURGER KING PEOPLE. YOU TRY TO RUN DOWN ANOTHER BORDER AGENT, WELL YOU ARE GOING TO GET A VEHICLE OR BODY FULL OF LEAD STAY HOME IN MEXICO AND YOU WON'T END UP GETTING SHOT.

Smuggling suspect shot by Border Patrol remains hospitalized

    By Jose Luis Jiménez

    6:34 p.m. September 17, 2009

SAN DIEGO – An alleged smuggler shot by Border Patrol agents as he drove a pickup truck toward them Wednesday evening is expected to survive, authorities said.

The man was attempting to pick up two illegal immigrants who crossed into the United States from Mexico through Smuggler's Gulch in the Tijuana River Valley, authorities said Thursday. His identity was not released, but he is believed to be a 22-year-old illegal immigrant.

The incident ended in the nearby neighborhood of Nestor, where the man attempted to enter a resident's home before he was captured.

The suspect remained hospitalized Thursday and under the guard of federal agents. He could face several felony charges, including assault and human smuggling, authorities said.

The incident started about 6:45 p.m. Wednesday when two Border Patrol agents spotted a man and a woman near Monument Road west of Hollister Street, said San Diego police homicide Lt. Kevin Rooney, who investigated the shooting.

While in custody of the agents, the woman received several phone calls from a smuggler who was scheduled to pick up the pair, Rooney said. An agent pretended to be the woman's male companion and arranged to have the pair picked up, Rooney said.

The alleged smuggler, in a Ford F-150 pickup truck, drove south on Hollister Street and then west on Monument Road. Agents asked the woman to walk out from some nearby bushes toward the road. A Border Patrol agent followed the woman and saw the man drive to a dead-end on Monument Road. He turned around and sped toward the agents at about 50 to 60 mph, the lieutenant said.

One agent stood in the middle of the road in an attempt to stop the vehicle and his partner stood to his left. When the driver refused to stop, both agents fired several rounds, Rooney said.

The truck missed the agents, headed north on Hollister Street and ended up on a cul-de-sac on Gayo Court, authorities said. The driver ran from the truck and through the yards of several homes.

One witness said the man jumped into her yard and attempted to enter her home just before she was able to lock the door. Moments later, agents jumped into her yard and asked if she saw the man. She pointed them to the front yard, where the man was detained.

The man was caught on Leon Avenue, west of Hollister Street, and was taken to a hospital.

No Border Patrol agents were injured.

The FBI is leading the investigation and will give its findings to the U.S. Attorney's Office, which will determine what charges will be filed, said Agent Darrell Foxworth, an FBI spokesman.

Watch the agents get charged for this.
