    A 28-year-old Brazilian will spend Christmas in jail on rape and kidnapping charges.

    Evandro Doirado, an illegal immigrant, is being held without bail on charges that he abducted a woman and her 2-year-old son at knifepoint in Framingham and held them for two days.

    They were rescued Wednesday in Plymouth after the woman asked a liquor store clerk to help her. The clerk called police and Doirado was arrested.

    A hearing on Friday to determine whether he should be released on bail was continued until Tuesday at the request of defense lawyer David Nagle.

    Prosecutor Shelby Smith asked Judge Thomas Brownell to order blood sample testing, but Nagle objected. The judge will hear arguments on Tuesday on whether to allow a blood test.

    Smith also submitted a request from federal immigration officials requesting that Doirado be turned over to them if he is released for any reason.

    Doirado has pleaded not guilty to two counts of aggravated rape, kidnapping of a child, kidnapping and sexual assault while armed, two counts of threatening to commit a crime, and assault and battery with a dangerous weapon.

    He also faces charges of assault while armed with an intent to kill, assault and battery with a dangerous weapon, and carjacking in Framingham.

    The names of the victims were not released. Six family members were present at the hearing, but had no comment.

    DA wants suspect tested for HIV

    PLYMOUTH -- A Framingham man charged with kidnapping a woman and her toddler last Saturday and raping the mother over a period of two days likely carries the HIV virus, a prosecutor alleged in a motion filed in court yesterday.

    Evandro Doirado, 28, was in Plymouth District Court yesterday for a hearing to determine if he was a danger to the public after the weekend crime spree he was alleged to have begun in Framingham and ended in Plymouth.

    Prosecutor Shelby Smith filed a motion with Judge Thomas Brownell to test Doirado for HIV, according to court records.

    In the motion, Smith said it is "likely" the rape suspect is HIV positive.

    Doirado’s lawyer, David Nagle, argued against the motion.

    "I’m not in a position to consent to this," said Nagle. "There is no legal basis for this."

    Brownell did not rule on the motion and did not say when he would.

    Also in court, Smith said federal Immigration and Customs Enforcement authorities have issued a detainer warrant against Doirado because he is a native of Brazil who may be in the country illegally.

    If and when Doirado is released from custody, federal officials would take custody of him.

    The dangerousness hearing itself was continued until Tuesday. Nagle asked for the postponement because he did not receive supplemental police reports until late Wednesday and has not reviewed them.

    Several friends and family members of the 25-year-old victim were in court yesterday, but declined, through a court official, to make a statement to the assembled TV and newspaper reporters.

    Doirado, who is charged with two counts of aggravated rape, two counts of threatening to commit a crime, assault and battery with a dangerous weapon, kidnapping of a child and kidnapping with armed sexual assault, will continue to be held without bail at the Plymouth Jail until Tuesday’s hearing.

    It is still unclear when Doirado will appear in Framingham District Court or exactly what charges he will face.

    The ordeal began last Saturday at around 8:30 p.m. when Doirado, of 1620 Worcester Road, is accused of stabbing Roberto Cornejos, 34, of Natick, in the neck after a botched drug deal.

    Thinking he had killed Cornejos, Doirado allegedly drove to Wal-Mart and kidnapped the woman and her 2-year-old son at knifepoint, and raped her at locations in Framingham, Natick, and authorities believe, a McDonald’s parking lot in Hanover.

    Doirado kept the woman and her baby locked in the Pilgram Sands motel in Plymouth all of Sunday, repeatedly raping her while threatening to kill the child if the mother did not comply, according to authorities.

    The ordeal ended on Monday at 8:55 p.m. after Doirado brought the woman to Bradford Liquors near the hotel, and she mouthed "help me" and the name of the motel to an alert clerk, who called police. Doirado was arrested a short time later.

    So far, in Framingham, Doirado has only been charged with crimes against Cornejos. He is charged with assault with the intent to kill, carjacking and assault and battery with a dangerous weapon. Lt. Vincent Alfano said on Tuesday more charges will be filed.

    Kidapping suspect may have HIV

    PLYMOUTH (Dec 24) The nightmare may not have ended for the Framingham woman who was kidnapped from a mall parking and raped in front of her 2-year-old son.

    According to court records, prosecutors fear rape suspect Evandro Doirado may have infected the woman with the HIV virus.

    Prosecutors Friday filed a motion seeking to force Doirado to submit a blood sample that can be tested for the disease.

    The motion, filed by assistant district attorney Shelby Smith, states Framingham police believe Doirado will test positive for the disease because of his known drug use in their community. The motion cites concerns for the victim's health and safety, noting allegations she'd been raped repeatedly by Doirado before local police rescued her Monday night outside the Pilgrims Sands motel.

    Prosecutors also said Doirado is an illegal alien from Brazil, under investigation for possible deportation by federal immigrations officials.

    Doirado traveled to district court under heavy guard Friday for a slated dangerousness hearing that would have brought him face-to-face with the victim's family.

    The wall of a lock-up cell separated Doirado from the family instead. The clan sat silently in the back of the courtroom as judge Thomas Brownell waived Doirado's presence in court at the request of defense attorney David Nagle Jr.

    Brownell also continued the dangerousness hearing and the hearing on the motion for blood testing to Tuesday. Nagle requested the delay, noting he had only received police reports of Doirado's case Thursday night.

    Nagle told the judge he appreciated the state's concerns for the victim but needed time to consider the blood test request given the likelihood physical evidence will play a major role in the case. Nagle later refused to discuss the case.

    Doirado, 28, is accused of kidnapping the 25-year-old victim and her 2-year-old son from a Wal-Mart parking lot in Framingham last Saturday night.

    He allegedly raped her repeatedly, threatening to kill the boy if she did not cooperate. Officials say Doirado had earlier stabbed a drug dealer after a deal went bad and thought he had nothing to lose in kidnapping the woman because he had already killed someone. The stabbing victim survived.

    Local police officers rescued the rape victim Monday night after she was able to alert a clerk at Bradford's Liquors that she needed help. The clerk, who also works as a counselor at the South Shore Women's Center, called police.

    Officers arrested Doirado minutes later in the parking lot of the waterfront motel. He faces charges of kidnapping with sexual assault, kidnapping of a child, assault and battery by a dangerous weapon (knife) and two counts each of threatening to murder and aggravated rape. Doirado also faces a charge of attempted murder in Middlesex County.

    He is being held without bail at the county jail.

    Police: Stabbing escalated into rape

    FRAMINGHAM -- The fate of a Framingham woman kidnapped at knifepoint Saturday and reportedly raped for 48 hours could have been different if Roberto Cornejos had told authorities what really happened when he was stabbed, police said yesterday.

    Cornejos, 34, of Natick was stabbed in the neck Saturday. He told police he was stabbed after a group of men tried to rob him, but authorities said he was actually stabbed by Evandro Doirado during a drug deal gone bad.

    But because police did not know Doirado had stabbed Cornejos, they were not looking for him.

    After the stabbing, Doirado told police he thought he had killed Cornejos, and decided to live it up before going to jail. He allegedly went on a 48-hour crime spree, kidnapping a woman and her son, and raping the 25-year-old in front of the child repeatedly in Framingham, Natick and Plymouth.

    If police knew the truth about the stabbing, it is possible the woman may not have had to suffer for two days, Deputy Police Chief Craig Davis said yesterday.

    "There’s no way to know what would have happened," said Davis. "This could have gone in a thousand different directions. Unfortunately it went in the direction it did."

    Now police are investigating Cornejos, Davis said. He said it is possible he could be charged for filing a false report.

    "We’re trying to determine what we’re going to do with him," Davis said.

    Doirado, 28, of 1612 Worcester Road remained in custody yesterday in Plymouth, facing numerous rape and assault charges. He is scheduled to appear in Plymouth District Court tomorrow for a hearing to determine if he is a danger to the public. He is being held without bail until then.

    So far in Framingham, Doirado has only been charged with the attack on Cornejos. He is charged with assault with the intent to kill, carjacking, assault and battery with a dangerous weapon and assault and battery.

    Police will sit down with the Middlesex District Attorney’s office to decide what charges will be filed against Doirado in connection with the incident with the woman.

    "We will assist with the sexual assault aspect of that because we have people who can talk to her," said Middlesex District Attorney’s office spokeswoman Emily LaGrassa. "They’ll probably wait until after the dangerousness hearing."

    On Saturday, authorities say Doirado kidnapped the woman in the Wal-Mart parking lot using a 13-inch knife. She was picked at random, police said.

    Doirado brought the woman and her child to a Framingham apartment complex’s parking lot and raped her, police said. He did the same in the Natick Stop & Shop parking lot.

    Later that night or early the next morning, Doirado brought her to the Pilgrim Sands motel in Plymouth, where he raped her repeatedly until her rescue Monday at 8:55 p.m., police said.

    She was saved after she mouthed "Help me" and the name of the motel to a liquor store clerk, who called police.

    The woman was reported missing by her family at 3:12 p.m. on Sunday, about 15 1/2 hours after she was kidnapped. Davis said she was reported missing when she did not go to her sister’s ho Sunday as was planned.

    Doirado does not have a long criminal history. Davis said Framingham Police had arrested him for a theft, and he was a victim of a domestic assault.

    The lack of a record is not an indicator of someone’s violent tendencies, Davis said.

    "We have had people who have done nothing in their lives who have committed horrendous murders," said Davis. "We’ve also had people who have six-page records who have never hurt anyone. That’s not a good gauge of what someone will do."

    This story originally came out with no mention of citizenship status,
    but, as Bootsie noted, these incidents are the rule, rather than the exception,
    i've waited until the details came out. Rule validated again....

    Is dubya thrilled to know that his policies & administration are responsible for
    the memorable holiday experience of this young mom and her 2-year old?

    What can be said? As a nation, we're cursed by having bush as president.

    I like that quote, Zorch. You should make that your signature.

    I guess we will have to excuse Bush for all of his mistakes because, remember, the man does NOT READ THE NEWSPAPER NOR WATCH THE NEWS. He relies on his advisors to bring him up to date on the NEWS, for God's sake. This man is our PRESIDENT and he doesn't read the news for HIMSELF. THAT is damn SLACK and SORRY. So, his "trusted advisors" probably just don't tell him about all of the horror stories of illegals committing brutal and heinous crimes.

    PS--I was JOKING about "excusing Bush"!! I excuse that MANIAC FOR NOTHING!! We need to start sending him THOUSANDS of those plaques that Truman kept on this desk saying, "The buck stops here".
