    The Acquittal of Roy Warden

    TUCSON, AZ – Roy Warden is fed up with illegal aliens and tells them, “You may not enter our country without our permission,” adding, “Go home to Mexico and overturn your own corrupt government and stop trying to control ours.” Warden also pushes free speech to the limit, flexing fierce constitutional muscle as he exercises his rights.

    Along with his acute political incorrectness and recognition as the “notorious Mexican Flag burner,” Warden’s even earned himself a spot in the Southern Poverty Law Center’s Fall Intelligence Report.

    Warden shows up at his rallies well equipped, packing a 9 mm Glock, bottles of water, a bullhorn and a Mexican flag or two.

    Setting off a political firestorm, Warden burned a Mexican flag while conducting a political demonstration on the Armory Park Shuffleboard Court on April 10, 2006 in opposition to open border policy and 15,000 violent open border activists. Six activists, led by Pima County Legal Defender Isabel Garcia, who is also co-chair of Derechos Humanos (Human Rights) Coalition and Alianza Indigena Sin Fronteras (Indigenous Alliance without Borders), were arrested for charges of aggravated assault against a peace officer, interfering with a government operation, hindering prosecution and disturbing the peace.

    It wasn’t until the following day that Warden was charged with assault, criminal damage and reckless burning. The media gobbled it up.

    Fox News 11 cameraman Ruben Fuentes claimed Warden assaulted him and the state claimed Warden committed arson causing criminal damage to the Armory Park Shuffleboard Court.

    In the interim, the county prosecutor never filed charges against five of the six open border arrestees.

    But, for the past six months, Warden says Garcia, the open border thugs, the Pima County media, lawyers and prosecutors have been “shooting off their big fat mouths on how they were going to ‘get’ me.”

    Undaunted and confident he’d be acquitted, Warden refers to his demonstrations as “legal, well-organized and extremely provocative First Amendment activities.”

    Last month, for the sixth year in a row, the Pima County Board of Supervisors voted 4-1 in favor of donating $25,000 to Humane Borders, which maintains water stations on both sides of the Arizona/Mexico border, despite several people voicing objections, including Warden, who said, “The only humane borders are borders that work. By providing water stations, you are only enticing people to their deaths.”

    On Wednesday, Nov. 1, Warden finally had his day in court before Tucson Municipal Judge Eugene Hays, whom Warden said “simply did not find Fuentes or the state’s evidence credible,” and in front of a packed courtroom, Hays declared Warden not guilty on all three counts.

    Warden said Hays was to be commended for his “control of the trial,” citing Hays was under tremendous political pressure from all sides. “I know,” said Warden, “because I applied some of it myself.” His victory came and went with barely a peep from the media.

    Shortly after his flag-burning demonstration, Warden said he hoped legal Hispanics who said they too were fed up with the crime and depressed wages brought about by the tidal wave of illegal invaders, would speak out.

    They did. Assisted by the Federation for Immigration Reform, You Don’t Speak for Me was launched in May.

    Chaired by the highly decorated Col. Al Rodriguez, the group currently has about 3,000 members nationwide.



    One of the group’s founding members, Claudia Spencer, 37, a citizen who came here legally from Mexico, while addressing the National Press Club in Washington, said, “… please don’t allow the rantings of the hordes of shameless, ungrateful, illegal foreigners to cause you to doubt yourselves on this issue.” Meanwhile, the federal government can’t seem to determine whose side it’s supposed to be on – that of lawful American citizens or lawbreaking foreign invaders.

    They’re not the only ones
    In October, two former border patrol agents from El Centro, Calif., Mario Alvarez and Samuel McClaren, were each sentenced to over six years in prison for accepting bribes of nearly $200,000 in exchange for releasing smugglers and illegal aliens from federal custody.

    At the other end of the spectrum, those trying to secure the border are in a war zone.

    Last month in the Rio Grande Valley sector, a Mexican national fired at two agents just outside McAllen, Texas, hitting one agent in the foot before escaping into a wildlife refuge.

    Then there’s former Texas Border Patrol agents Ignacio Ramos and Jose Compean, who were just sentenced to 11 and 12 years in prison, respectively, for doing their job; attempting to apprehend drug smuggler Osvaldo Aldrete Davila.

    U.S. Border Patrol – Tucson Local 2544 responded with, “This outrageous miscarriage of ‘justice’ should be a warning of the worst kind to every man and woman who wears the uniform. Do your job – Go to jail!”

    The outrage continued, “Border Patrol Agents are outgunned, overwhelmed, discouraged, demoralized, and, as if that isn’t enough, we are now viciously attacked by the very government who should be supporting us.”

    Then, just last Friday, after the city of Escondido, Calif. passed an ordinance prohibiting landlords from renting to illegal aliens, the ACLU, the Mexican American Legal Defense and Education Fund, the Fair Housing Council of San Diego, People for the American Way, etc.filed a complaint in federal court on behalf of Plaintiffs Roy and Mary Garrett, Escondido Human Rights Committee, Jane Doe 1 and Jane Doe 2, to bar its implementation.

    While the Garretts own rental units in Escondido, Jane Doe 1 and Jane Doe 2 are both described as “gainfully employed” illegal aliens from Mexico that rent apartments in Escondido where they reside with their minor U.S. citizen children who attend school there.

    The plaintiffs contend the majority of the illegal alien population in Escondido is part of mixed status families with over 25 percent “having children who are U.S. citizens and who have a right to live wherever they want and go to school wherever they choose.”

    It claims the ordinance punishes such citizens and deprives them of “their right to access the housing and schools of their choice, in violation of both state and federal law.”

    Last, without missing a beat, the politically incorrect Warden warned illegals in Tucson last week, “You better not vote this Tuesday,” citing cameras were already in place near Hispanic polling places, and said those who do would be subject to arrest.

    And for Rep. Raul Grijalva, D-Dist. 7, who cheered on the illegal masses in April with, “Today we march, tomorrow we vote,” Warden adds, “And the next day you go to jail!”

    If our government wasn't so corrupt ....This would not be in question!

    I like Warden!

    Roy Warden might be one of few contemporary Americans the
    Founders would even recognize.
