VICTORVILLE • An illegal immigrant who admitted to shooting and killing an Apple Valley good Samaritan four years ago was convicted of second-degree murder Friday.
The jury convicted Joaquin Escobar, 24, formerly of Victorville, of second-degree murder after one day of deliberations.
The jurors also found the allegation of discharge of a gun causing death to be true. Escobar can face up to 40 years to life in prison. Sentencing is scheduled for Sept. 2.
Although the prosecution was seeking a first-degree murder conviction, Deputy District Attorney David Foy said his office and the victim’s family are pleased with the verdict.
Escobar showed up at a home in the 15500 block of Fourth Street in Victorville on March 27, 2006. When he saw his ex-girlfriend with the victim, Richard Avelar, 29, Escobar tried to drag her out of the house. Escobar shot Avelar in the chest after a short altercation with the victim, according to testimony.
Escobar, an illegal immigrant who had lived in the U.S. for 17 years, was identified as the shooter soon after the incident. The manhunt was on, but he had already fled to Mexico. He was arrested in Mexico City before federal officials transported him back to San Bernardino County.
