Sword-slaying suspect denies 2 new charges

RANCHO CUCAMONGA - Prosecutors filed two additional felony charges Thursday against an Upland woman accused of killing her husband with a sword.
Naomi Valdivia, 33, pleaded not guilty in West Valley Superior Court to charges of assault with a deadly weapon and spousal abuse. She previously pleaded not guilty to a murder charge.
Prosecutors say Valdivia stabbed Jose Luis Gonzalez, 36, at the family's Upland apartment in the 800 block of West Orchard Court on April 26 while her five children were in the unit. Two of the children were fathered by Gonzalez.
Thursday's hearing was Valdivia's first to be attended by Gonzalez's family members and friends who didn't find out until mid-July that Gonzalez had been killed.
Silvia Gonzalez Ortiz, Gonzalez's mother, said Valdivia told authorities her husband had no living relatives.
Because of Valdivia's statements, Gonzalez's body was left unclaimed in a county morgue for nearly three months, Ortiz said.
"She lied and said he had no family when she knew where we lived," said Ortiz, who was fighting back tears during an interview.
She said the family found out about her son's death only after an Upland investigator discovered a missing-person's report that she had filed about Gonzalez.
"How does anybody do that?" said Ortiz, referring to Valdivia's failure to notify Gonzalez's family. "You have to be heartless."
Ortiz said Thursday that Gonzalez had not been
in contact with the family since 2002 - primarily because Valdivia would get angry with Gonzalez when he would call his family.
Valdivia told investigators that she attacked her husband with a sword only after he first approached her with the weapon. Ortiz said she believed that was "most definitely" a lie.
"I would bet my life on it," she said.
Ortiz said she would want to see Valdivia sentenced to "100 years (in prison) with the key thrown away. She does not deserve to be here. She took a life in cold blood."
Ortiz said she would continue to attend Valdivia's court hearings.
"We are (Gonzalez's) voice," she said.
Charges against Valdivia carry a maximum sentence of 26 years to life, said Deputy District Attorney Ted Smith, the prosecutor.
Valdivia will next appear in court on Aug. 29.

It is bad enough that the couple came at each other with weapons with five children watching. Were they here legally or just illegals taking out their hot tempers with lax American laws?
