    San Juan Capistrano man arrested in I-5 rape

    A San Juan Capistrano man has been arrested in connection with the weekend rape of a woman on the side of Interstate 5, authorities said today.

    Alejandro Martinez Leyva, 25, was arrested about 9:30 p.m. Tuesday at his home, about a mile from where the assault occurred, said Orange County Sheriff's Department spokesman Jim Amormino.

    Detectives traced the man to his residence in the 26400 block of Calle San Luis with a physical description provided by the victim, a 24-year-old San Diego County woman. Parked outside the home, authorities found a dark, late-model sedan with a spoiler and baby's car seat that matched a description of the vehicle the victim had given.

    The woman was driving south on the freeway toward San Diego about 2:30 a.m. Saturday when she spun out of control near the Junipero Serra Road offramp after trying to avoid hitting a tow truck, authorities said.

    She hit a freeway barrier, rendering her car inoperable. She then pulled onto the shoulder and called for help on her cellphone.

    A man pulled up in front of her and, in broken English, offered to help, officials said. When she refused his offer, he grabbed the phone from her hand, forced his way into the car and raped her.

    Officials called the attack an unusually brazen sexual assault -- committed alongside perhaps hundreds of passing vehicles and potential witnesses. He said the suspect was found through "good old-fashioned detective work."

    Detectives linked Leyva to the victim's car with physical as well as forensic evidence, and the victim identified him as her attacker in a lineup.

    Leyva, who works as a gardener, was being held without bail at the Orange County Jail, with an immigration hold placed on him.

    He has no prior convictions, Amormino said. He has been ruled out as a suspect in the Oct. 7 rape of a woman walking to work along historic Los Rios Street in San Juan Capistrano, even though the descriptions of both attackers were similar.

    A suspect was held without bail Wednesday in connection with the weekend rape of a 24-year-old woman near a freeway off-ramp in San Juan Capistrano, according to the Orange County Sheriff's Department.

    Alejandro Martinez Leyva, 25, was arrested late last night at the San Juan Capistrano home he shares with others near the location of the assault, according to the department's Jim Amormino.

    His name had initially been withheld until the victim, who was attacked as she returned to her home in San Diego County about 2:30 a.m. Saturday on the San Diego (I-5) near Junipero Serra Road, could be shown his photo to make an identification.

    The victim identified the man as her alleged attacker, Amormino said.

    Leyva, a gardener, was being held at the Orange County Jail, Amormino said, and an immigration hold was placed on him.

    Leyva was eliminated as a suspect in the Oct. 8 rape of a 51-year-old woman who was walking to work in the 31700 block of Los Rios Street in San Juan Capistrano -- even though descriptions of both attackers were similar, Amormino said.

    In the weekend attack, detectives had a good description of the suspect's vehicle and, using physical and forensic evidence from the scene, were able to come up with a suspect, Amormino said.

    He did not know if the suspect was included in law enforcement databases.

    Detectives "located the car and staked out the home before obtaining a search warrant," Amormino said.

    They obtained additional evidence at the home, he said.

    About 15 people described as friends and co-workers of the suspect live in the home and several people had access to the vehicle, Amormino said.

    A baby seat was still in the car, Amormino said.

    The woman was driving southbound when her car spun out of control. She was on a cell phone when the suspect pulled in front of her disabled car and offered help, but the victim said she did not need assistance, Amormino said.

    He grabbed the phone and threw it, then forced her into the front seat of the car and raped her, Amormino said. After the suspect fled, the woman found her cell phone nearby and called 911.

    The city council will not do anything to enforce civic codes,i.e., too many people occupying an apt! Their excuse is that they've been sued before. Perhaps they need to be sued for not doing anything!!!

    Interesting idea.

    Heard about this story while I was out and about listening to the radio and made mental note to check when I got home.

    Poor woman out in the rain, has a mishap like that and look what happened.....every woman's nightmare!

    Yeah no kidding. Oh but he's here to make a better life for himself...I want to get sick. Whatever happened to the Save Our State people? Di they just give up on Mexifornia?

    I wonder if the victims can sue not just the Landlord but the Landscape company that hired him, knowing full well he was an Illegal Alien. Had they not helped him, he wouldn't be here in the first place.


    Very important ladies, never roll down the window if you have to pull over. Just roll it down very little and keep all doors locked at all times.

    Too bad she wasn't armed

    You know the idea of a card with these perpetrators on them would be a good idea.

    Just a 'Greetings' card.


    Maybe we could get pictures of them, with a list of their crimes and description of their victims and make up some cards to email to all the pro-illegal lawmakers, Mr. Chertoff and of course the President.

    Wouldn't it be neat to have them broken down by states and then do a state mailing to lawmakers and Govs, for each crime in their state.

    Maybe take it on down to the local level -


    Maybe even find out their employers and send them a card.
