A Santa Rosa man was facing possible deportation after his arrest for alleged drunken driving and child endangerment because he had his 4- and 6-year-old children in the car, the CHP said.

Humberto Damian, 45, was in custody on an immigration hold Thursday at the Sonoma County Jail after his early Wednesday morning arrest.

The CHP said an officer on routine patrol observed Damian ahead of him on Highway 101 in Rohnert Park around 2:13 a.m. Wednesday.

The officer said he was speeding at 70 mph in a construction zone and weaving so badly he nearly struck a concrete center divider, the CHP said.

Upon stopping Damian, Officer Mike Tonelli determined Damian was driving under the influence of alcohol and had no drivers license.

In addition to his wife, Damian also had his 6-year-old son and his 4-year-old daughter in the car.

He was arrested for suspected drunken driving with an enhancement for having under-age passengers, driving while unlicensed and child endangerment.

At the jail, he was put on an immigration hold because of questions about his status in the country, personnel said.
