Calif. nanny won't face third trial in child death

AUBURN, Calif. (AP) - Placer County prosecutors have decided against a third trial for a nanny accused of shaking a 16-month-old baby to death.

The decision follows two mistrials when separate juries deadlocked after hearing the case, most recently last month.

Jurors were unable to decide the guilt or innocence of Veronica Martinez Salcedo, who was caring for the baby when she died in May 2006.

Prosecutors say she shook Hannah Rose Juceam so hard she caused a fatal brain injury. Salcedo's attorney says the child died from an unrelated illness.

The child's family, which lives in the Sacramento suburb of Roseville, is suing the nanny.

She is in the country illegally and is likely to be deported to Mexico after an immigration hearing.

The nanny who went through two mistrials in Placer County courtrooms on charges that she caused a baby's death by shaking it violently has been deported to Mexico.

Veronica Martinez Salcedo, 38, was given the removal order in U.S. Immigration Court in San Francisco last Wednesday by Judge Michael J. Yamaguchi.

Lori Haley, a spokeswoman for the U.S. Immigration and Customs Enforcement, said Martinez Salcedo was sent back to Mexico the next day.

Martinez Salcedo was arrested by Roseville police following the 2006 death of 16-month-old Hannah Rose Juceam, who became unresponsive while in the nanny's care.

Hospital physicians concluded that Hannah had been shaken violently, causing fatal brain injuries.

However, the nanny's attorney, Mary Beth Acton, argued in the two criminal trials that the child died of a stroke caused by a blood clot from a previous injury or an illness.

The first jury deadlocked at 10-2 in favor of conviction last October, while a second jury voted 9-3 for acquittal in June. The Placer County District Attorney's Office decided against a third trial and asked for a dismissal of the case.

Because of her illegal status, Martinez Salcedo was held in the Placer County jail in Auburn for more than two years until last week's deportation.

Immigration officials say Veronica Martinez Salcedo was ordered deported August 6 after prosecutors decided not to pursue a third trial on assault charges in the case.

Prosecutors say Salcedo shook 18-month-old Hannah Juceam so hard she suffered a fatal brain injury. Salcedo's attorney says the child died of a stroke caused by a blood clot.

Two separate juries deadlocked on the case.

Salcedo had spent the last two years in jail because she was an illegal immigrant.
