    Assemblyman blasts ending parole for illegals

    California will no longer keep illegal immigrants on parole after they serve their sentences and are deported, leaving it to the federal government to prosecute those who sneak back across the border.

    The parole policy change announced Monday will save the state an estimated $10 million annually and reduce the crowded prisons' population by about 1,000 inmates.


    Assemblyman Jim Nielsen, who represents the 2nd Assembly District, sounded "a warning alarm to all Californians" regarding the decision to grant early discharge from parole to at least 12,000 foreign-born offenders.


    Nielsen, who served 17 years on the state Board of Prison Terms and 12 years in the state senate, spoke about the potentially dire consequences to public safety under this new policy taking effect today.


    "I understand the desperation of CDCR. They face possible federal court-ordered release of prisoners due to overcrowding and a recent reduction of $400 million, or 4 percent, to their $10 billion budget. They see this as a way to save $10 million annually, but I see it as too great a cost to public safety," he said in a press release. "Their response to the budget cut must not compromise public safety or justice. This policy egregiously does both"


    About 1,600 deported parolees were caught back in California in 2007, according to the most recent statistics available. Previously, they'd be sent back to state prison for four to eight months for violating their parole.


    Under the new policy, the suspects will be turned directly over to federal immigration authorities. They will not be on parole, and therefore could not have their parole revoked and sent back to state prison.

    Uhhhh.....call me crazy.....

    Call me crazy here, but if we are going to LESSEN Prison sentences for NON VIOLENT OFFENDERS due to space limitations, why not free up that space by selecting ENOUGH LEGAL AMERICAN CITIZENS (many in prison on far less serious charges than many illegal aliens) to make room for these Illegal Aliens...Illegal Aliens should serve their time, should not be given preferential treatment by the virtue they are in our country illegally.

    Think about it...we cut loose Illegal Aliens early so they can go home AND COME RIGHT BACK AGAIN? Let them sit in a gray prison for a few years, chances are they will think twice before coming back to America.

    Since the federal government only reimburses CA. 11 cents for each $ they spend to incarcerate illegal aliens CA. can't afford to keep locking them up.

    I understand the eleven cents arguement...but, if you release one low risk American prisoners (say a woman that wrote bad checks to feed her family because an illegal alien stole her job) so you can keep the Illegal Alien behind bars, the expense issue is a wash.

    Under the new policy, the suspects will be turned directly over to federal immigration authorities. They will not be on parole, and therefore could not have their parole revoked and sent back to state prison.
    California Corrections Secretary Matthew Cate sent a letter to U.S. Homeland Security Secretary Janet Napolitano on Friday informing her of the change.
    Thanks to special order 40, the LAPD will not even inquire as to someones immigration status during a routine stop! So how are local officials going to identify that a person is in fact a convicted felon who has already been deported? He will no longer be in the system as being on parol.

    Do we once again have to wait for one of these convicted, illegal felons to kill another innocent American citizen before they ask!

    JD. Finger print checks are not done during routine traffic stops. I guess their felony conviction would show up in the system so long as the illegal gave the same name in which he was convicted under. We know many of these invaders use several different names and identifications.

    The next questions is was the State of California turning these illegal felons over to the Feds for prosecution after they had served their time for the parol violation prior to enacting this change? They should have been.

    I guess we will have to see how it goes and hope for the best...

    Some police departments now have an electronic finger print ID system that a cop in the field can use to ID anyone with no ID or with ID that the cop thinks may be fake. They just put the right thumb on this device and it is sent by wireless internet to compare it with the DMV finger print system and if that shows nothing they can then check it against the nationwide finger print system. I saw one in action. It only takes a couple of minutes most times. Or they can put every finger on the person into it and see if any of them come back from a crime scene. It would be great if every police department could have these.
