    U.S. border cop charged with murdering Mexican


    BISBEE, Arizona (Reuters) - A U.S. Border Patrol agent must stand trial for murder in the shooting of a Mexican man trying to enter the United States, an Arizona judge ruled Monday in a case that drew criticism from Mexico.

    Agent Nicholas Corbett was charged in April with four counts of homicide in the January 12 shooting of Francisco Dominguez Rivera shortly after he crossed the border illegally on a stretch of desert between Douglas and Naco.

    Cochise County Justice of the Peace David Morales ruled the evidence supported lesser charges of second-degree murder, but threw out charges of first-degree murder, which supposes premeditation.

    The ruling followed a preliminary hearing that heard evidence from three illegal immigrants present at the shooting, a pathologist, county sheriff's detectives and two Border Patrol supervisors.

    No date was set for Corbett's arraignment.

    Following the killing, Mexico's Foreign Ministry complained of "disproportionate violence" and instructed the Mexican Embassy in Washington to investigate the circumstances.

    Last year, border police captured 1.1 million undocumented immigrants crossing over the border from Mexico and recorded a soaring number of attacks on agents.

    Lawyers for Corbett argue he shot Dominguez Rivera in self-defense after he was threatened with a rock.

    An agent representing the local chapter of the Border Patrol's union said he believed the charges against Corbett would not hold up at trial.

    "I don't think the prosecution has a good case, and the defense will absolutely beat it," Brandon Judd said after the hearing.

    Last year, two Border Patrol agents were prosecuted in Texas for shooting an unarmed Mexican drug smuggler in the buttocks.

    They were convicted and sentenced to more than 10 years in jail, becoming a cause celebre among some conservatives and anti-illegal immigration hard-liners

    The federal prosecuter that determined he would prosecute this case needs to be investigated simultaniously for ties to the Mexican governement

    If this goes to trial and he is convicted this would set a disgusting precedent. The illegals would all know they can freely assault a lone Border Patrol agent, then when he has to defend himself from certain harm or death and kills one of them, they can all get together and lie and no doubt our government would believe the word of the invaders over the agent. No Border Patrol agent would be safe from assault if alone and faced with a large group of illegals.

    Wasn't there a video showing the illegal about to throw a rock at the agent just before the agent shot him to protect himself? The video clearly shows the shooting was in self-defense, that is unless that was another case.

    I don't understand this border patrol assult. If you cross a border is that not a criminal federal offense. If you look like you even remotely are going to do harm then you would think that would be your problem if you were shot. That is the way it works in the USA for us legal Citizens.

    Yes "RockFish" there was a video and you could clearly the ilegal was going to throw a rock at the agent.
    This is a load of crap and a waste of taxpayer money just to apease the Mexican government.
    I think the Mexican government has it in that pea brain of theirs if they harrass us bad enough over this crap we will let up and allow their citizen to keep coming and keep sending money back to their country. NOT GOING TO HAPPEN MEXICO!!! Mind your own business!

    An group of people need to start an organization dedicated to helping border patrol agents and national guards in there legal battles.

    Make a plea for donations to pay for high profile lawrers that aren't in bed with the government or mexico and are not afraid to take them on.

    If border patrol agents know they have the American people behind them backing them up they won't be afraid to do there jobs.
