WHEAT RIDGE, Colo. - Admitted thieves are going free, while an elderly Wheat Ridge man is facing the possibility of spending the rest of his life behind bars, all, he says, for trying to defend his property and his life.

82-year-old Robert Wallace said in February that he looked out his window and saw two men hooking his flatbed trailer up to their pickup. He yelled at them to stop, but they sped away, stealing his trailer. He told police he fired two shots at the pickup.

Minutes later, police say 32-year-old Damacio Torres dropped 28-year-old Alvaro Cardona off at a hospital emergency room with a gunshot wound to the face.

Torres did not stay to talk with police, but they caught up with him later. According to court documents, he admitted he and Cardona stole the trailer.

Wallace did not want to talk on camera, but when we asked him if the two men threatened him he said, "They almost ran me over."

The Jefferson County DA's office said that neither Torres nor Cardona have been charged with anything at this point, even though Torres confessed to the crime. However, the homeowner, Wallace is facing twelve felony counts, including four counts of attempted first degree murder. If convicted, he could spend the rest of his life behind bars.

Sources say Torres and Cardona are believed to be in the country illegally and both have an arrest record. Cardona's record includes public fighting and numerous traffic offenses like driving without a license or insurance. Torres's record includes agricultural trespassing as well as a 2005 arrest for aggravated motor vehicle theft for which he was given a plea bargain to a lesser crime. Sources say Torres is also under investigation for being part of a major auto theft ring.

Wallace is out on bond and due back in court in September to enter his plea.

Neighbors say the thieves should be the ones facing charges and Wallace should be given an award for protecting the neighborhood.

Since Tuesday, many of you have been contacted by e-mail or telephone in response to media stories regarding the arrest and charging of 82-year-old Robert Wallace for attempted murder in the shooting of a trailer theft suspect in February. The news stories related to this incident have presented inaccurate information, left out important information and details, and have described his arrest as a travesty of justice. Since then, the Police Department and District Attorney’s Office have been criticized regarding Mr. Wallace’s arrest and as a result, there has been some public anger directed at us.

Because the case has been filed with the District Attorney’s Office there are legal constraints placed on the D.A. and I regarding what we can say about the case without jeopardizing the case. Nonetheless, I felt it was important to release the information contained within Mr. Wallace’s arrest affidavit, which is available for public disclosure that “connects the dotsâ€

If this man is convicted and jailed then it should be evident to all of us that we are no longer free individuals in a free society with a benevolent government. We need to make sure that the appropriate folks in the press are on top of this and don't allow this travesty to continue!!!

yeah...and the two illegal aliens are just gonna hang around waiting on the arrest warrants. Right. I am not a lawyer but I have been around long enough to ask the question to the Chief if you have a victim of a property crime and you have a suspect that admits to stealing the victims property then you have "probable cause" to make an arrest. Why the hell are these two not arrested.

I will give my opinion why not. The DA has higher charges placed against the elderly man then he would have against the two illegals and therefore he needs them as willing witnesses to testify. In exchange for their testimony he will offer them both a misdemeanor theft deal instead of a felony theft. Well, the creditbility of these two witnesses better be brought into play by the elderly man attorney.

This is just wrong and I don't see proper justice being served here. The elderly man better stick to his story that these two illegal losers tried to run him over so he used deadly force to protect his life.

If we had secure borders and laws across the country that allowed police to enforce immgration laws these two turds wouldn't have been able to commit these crimes and this elderly American wouldn't be having to defend his freedom from prision.

Absolutely sickening how our country has been bowing down to the illegal Mexicans and their President.

Open season in Colorado by Law Enforcement on United States Citizens; while the ILLEGALS of course go free. It seems that the local Law Enforcement is proud of the fact they have charged the United States Citizen and have allowed the ILLEGALS to run the streets. This reminds me of our former President. As the south of the Border ILLEGAL invaders are moving North along with their "family values" our past President often proudly stated again and again that the U.S. was lucky that the ILLEGALS didn't leave their family values south of the Border while they continue to invade the United States. Of course he failed to mention all of the murders, drugs, rapes and various other values the ILLEGAL invasion would produce. The violence will scurry North into our Nation the same as the ILLEGAL invaders have been successful in accomplishing; but not to worry the Special Interest Groups and Political Contributors will continue to prosper with their cheap labor furnished to the ILLEGAL EMPLOYERS by the ILLEGAL invaders.

Our FAMILIES are at the mercy of ILLEGALS and their anchors being murdered, raped, infected with disease, or robbed. We can see the results of the ILLEGAL invasion in our courts every day except maybe in Colorado where the ILLEGALS go free and the United States Citizen is arrested! But NOT to worry the Chamber of Commerce will get their cheap labor increasing their privatized PROFITS while socializing the benefits for their ILLEGALS on the back of U. S. Citizens, thanks to our past and current Presidents, the Congressional Leadership(?), and LOCAL elected and appointed officials!
