    Illegal immigrant who killed nun in accident was released by feds

    The man suspected of drunken driving and killing a Catholic nun in Prince William County this weekend is an illegal immigrant who was awaiting deportation and who federal immigration authorities had released pending further proceedings, police said Monday.

    The man, Carlos Montano, a county resident, had been arrested by police twice before on drunk-driving charges, and on at least one of those occasions county police reported him to federal authorities.

    "We have determined that he is in the country illegally. He has been arrested by Prince William County Police in the past," said Officer Jonathan Perok, a police spokesman, who said U.S. Immigration and Customs Enforcement was notified at the time of one of those arrests.

    Officer Perock said Montano was in deportation proceedings at the time of this weekend's killing, but was out on his own recognizance.

    A call to ICE was not immediately returned, but the incident raises questions about the agency's policy of only detaining some illegal immigrants awaiting deportation, while releasing others.

    The latest ICE statistics show the agency is actually detaining fewer people now on an average daily basis than they did in 2009.

    The Sunday morning crash killed Sister Denise Mosier and injured two other nuns as they were driving to a retreat at the Benedictine Monastery in Bristow, Va. The two injured nuns were in critical but stable condition, according to St. Gertrude High School in Richmond, run by the Benedictine Sisters of Virginia.

    This is from the Virginia DMV. It seems that Illegals aren't held to the same rules as U.S. citizens. The rules say a third offense becomes a class 6 felony with mandatory jail time. The court let a 2 time offender out

     If your driving privilege is revoked for a first
    or second DUI offense conviction and you
    receive another DUI, the license revocation
    period will run consecutively with the existing
    revocation period.

    revocation
     Prosecution as a Class 6 felony

    Conviction for DUI third offense within five years

     Permanent forfeiture of your vehicle (if you
    are the sole owner)

    BAC of 0.15% and not higher than 0.20% at the
    time of arrest
     First offense carries a mandatory, minimum
    five-day jail term in addition to all other
    penalties

     Second offense within ten years carries a
    mandatory, minimum ten-day jail term in
    addition to all other penalties

    BAC of 0.20% or higher at the time of arrest
     First offense carries a mandatory, minimum
    ten-day jail term in addition to all other
    penalties

     Second offense within ten years carries a
    mandatory, minimum 20-day jail term in
    addition to all other penalties

    A third conviction within ten years for driving on a
    license suspended because of a DUI-related offense
    is a class 6 felony and carries a mandatory term of
    one to five years or a fine of $2,500 or both.


    Any DUI offense will be reported to the Central
    Criminal Records Exchange by law enforcement at
    the time of your arrest. In other words, you could
    end up with a criminal record because of a DUI
    arrest.

    If you are under age 21, you cannot purchase,
    possess or consume alcohol. If law enforcement
    stops you for illegal consumption of alcohol, you are
    subject to administrative license suspension (ALS). If
    you are convicted of driving after illegally consuming
    alcohol and your BAC was at least 0.02 percent and
    less than 0.08 percent, you can be fined up to $500,
    have your driver’s license suspended for six months,
    and face a possible jail term.
    Regardless of age, if driving on a DUI suspended or
    restricted license, you may be charged with DUI if
    you drive with a BAC of 0.02 percent or higher.
    Persons under age 21 who drive while under the
    influence of drugs or with a blood alcohol content of
    0.08 percent or higher are subject to the same penalties
    as persons age 21 or older

    Newmexican, once again a case where illegal aliens are exempt from our laws. I've been crying this cause for years. Even when they do serve time, they get a shorter sentence in order to deport them quicker that only results in their next illegal re-entrey.
    Illegal aliens remain exempt from American laws, while they DEMAND American rights...

    The Feds are only focused on "violent criminals"... If you run a few people over while your drunk It's ok. After all,he Is just here In the United States to do the jobs that AMERICANS won't do.... One AMERICAN CITIZEN killed by an Illegal Is too many. We have to vote every left wing political hack out of office In 2010,and vote people In that take our laws and our sovereignty seriously....
