    Illegal immigrant released from jail because of wrong charge by police

    A man accused of fondling two pre-teen girls in a mobile home park swimming pool Sunday was mistakenly charged with a misdemeanor instead of a felony and released from jail on bond. But when police were told of their mistake Monday, they re-arrested the man, whom police say is also an illegal immigrant.

    Despite his arrest on two counts of unlawful sexual assault on children, immigration officials may not put an immigration hold on the man because they have “limited resources ... and terrorism is the top priority.â€

    ICE in Colorado is negligent in there enforcement of illegal immigration laws. I challenge them to account for their resources.

    Things have changed drastically for Manuel Ramirez-Cano, who was arrested Sunday on charges of sexually touching two girls in a Greeley swimming pool.

    » On Sunday, he was charged with a misdemeanor, immigration officials were not interested in him, and he was out of jail on a $3,000 bond.

    » Today, Ramirez-Cano is back in jail, facing two felony sexual assault charges, Immigration and Customs Enforcement has a hold on him, and his bond has been set at $100,000.

    He is accused of inappropriately touching two girls, ages 10 and 12 years old, while at the swimming pool at Woodland East Mobile Home Park, 2280 1st Ave.

    In an apparent mistake, the Greeley police officer who arrested Ramirez-Cano booked him on two charges of unlawful sexual contact. The charge is correct, but it should have included the fact that underage girls were involved.

    He was first released on two misdemeanor charges, but after hearing from neighborhood parents Monday, the police department added the age of the girls to the charge and re-arrested Ramirez-Cano on two felony charges.

    And, while the Immigration and Customs Enforcement didn't appear to be interested in Ramirez-Cano on Monday, after a call from Greeley police, ICE placed him on an immigration hold. He is in this country on a visa, but the visa expired, and that officially changed his status to an illegal immigrant.

    It appears that this "error" has been dealt with, but we have to wonder how many other similar instances are happening every day. This situation has overwhelmed our local law enforcement agencies as well as the courts. In my area, law enforcement does not even pretend to investigate property crimes. They simply make a report and put it on file for insurance purposes and just in case the thief happens to drop in their lap.
