AURORA, Colo.
- Federal immigration officials have placed a hold on a man being held on vehicular homicide charges in the deaths of three people, including a boy killed while buying ice cream.
Immigration officials say it appears that 23-year-old Francis Maudaniel Hernandez was born outside the country. ICE spokesman Carl Rusnok says the detainer means that Hernandez will be released to immigration authorities if the state releases him.
Hernandez is accused of running a red light in his SUV, hitting a pickup truck, which was sent hurtling into an Aurora ice cream store. The two women in the pickup were killed instantly and a boy in the store died later of his injuries.
Authorities say Hernandez, arrested after fleeing the scene, has an extensive criminal record.

That's a new PC way to say ILLEGAL!!!!!!!!!!!The difference between an immigrant and an illegal alien is the equivalent of the difference between a burglar and a houseguest. My son and I happened to drive by the scene of the crash just yesterday. People are still milling around, dropping off memorial gifts. It's a spectacle, you can't drive by and miss it.

Hundreds mourn Colo. hit-and-run victims
Published: Sept. 7, 2008 at 3:54 PM
AURORA, Colo., Sept. 7 (UPI) -- A Colorado father said at a weekend memorial vigil he is devastated by the death of his son in a hit-and-run crash that claimed three lives.
Aurora resident Vito Kudlis said the sudden loss of his 3-year-old son, Marten, in Thursday's accident has left his life in turmoil, The Denver Post reported Sunday.
"It hurts now," Kudlis said during Saturday's candlelight vigil at the scene of the accident. "It is freaky. It is crazy."
Marten Kudlis died along with Patricia Guntharp, 49, of Centennial and Debra Serecky, 51, of Aurora in a traffic accident caused one vehicle to smash into an ice cream store.
Police suspect Francis Hernandez, 23, ran a red light and crashed into a vehicle carrying Guntharp and Serecky, sending their vehicle into the ice cream shop where the child was struck by flying debris.
Hernandez was arrested and charged with leaving the scene, reckless driving and three counts of vehicular homicide, the Post said. Police said Hernandez, who also is being held on immigration charges, had been arrested a total of 16 times during the last five years.
