Court of Appeals to hear arguments on Arizona immigration law
PHOENIX Opponents of a law denying some public benefits to illegal immigrants are heading to court tomorrow to argue that one provision of Proposition 200 should no longer be enforced until its constitutionality is debated at trial.
The Ninth U-S Circuit Court of Appeals in San Francisco is hearing oral arguments on whether it should order the U-S District Court in Tucson to reverse its decision NOT to issue a preliminary injunction.
If the court in Tucson orders the injunction, the part of the voter-approved law that denies some public benefits to illegal immigrants will stop being enforced until a trial is held.
The trial would then determine whether it's constitutional to withhold the benefits. Another provision that deals with voting would not be affected.
The Court of Appeals' decision will be based on whether it feels people will be irreparably harmed if it doesn't order the Tucson court to issue the injunction.RIP Butterbean! We miss you and hope you are well in heaven.-- Your ALIPAC friends

There is a reason they call it the Ninth CIRCUS Court of Appeals. They are a bunch of left wing ninnnies who will undoubtedly reverse this opinion. Anyone want to bet?

We all see it is Judiciary Activism when the 9th circuits will over turn the Arizona population overwhelmingly past this and now it of course. What is the point in voting if what the people wanted gets overturned? There is non, it is Activist judges like the 9th circuit, which are making laws and ignoring the people, which voted. Something is wrong with this picture you think?

It is definitely wrong and we'll pray for the attorneys arguing for the people's will to prevail in accordance with our constitution.
"irreparable harm" is the argument for upholding an illegal taking of benefits from Arizona citizens?
Sure....the next thing they'll come up with is "does the bank robber convicted of robbery get out of his sentence because locking him up would cause irreparable harm?"
