Court upholds dismissal of lawsuit in immigrant case

PHOENIX - An Arizona appellate court says a trial judge was correct to dismiss a lawsuit filed by an Army reservist who was arrested in 2003 for detaining seven illegal immigrants at gunpoint at a highway rest stop.

The lawsuit filed by Patrick Haab accused the Maricopa County Sheriff's Office of false imprisonment, emotional distress and abuse of process for disclosing his military records.

Haab was arrested in 2003 and then released without being prosecuted. He said he held the immigrants at gunpoint because he feared for his life. Haab was a resident of New Paris, Ind., at the time.

A judge ruled that Haab failed to file an amended claim required under Arizona law as a precursor to a lawsuit against a government entity, and the Court of Appeals on Thursday upheld that ruling.
