Identity theft is stealing an identity of someone. They prosecuted under the wrong law. There is a US immigration law that makes it illegal and subject to 10 years in prison for impersonating a US citizen. If the illrhsl alien claimed to be a citizen and used the social security number to infer or imply that he was a US citizen, then they should have prosecuted him under the US immigration law instead of what are obviously deficient identity theft laws.

Then they should prosecute him for defrauding his employer into making social security payments on his behalf for which he's not eligible and for which they aren't liable.

Then the employer should file for a refund from the Social Security Administration for the sums they paid into the fund on his fraudulent illegal behalf.

Then Social Security Administration should sue the illegal alien for lost revenues they would otherwise collected from an employer of a legal worker.
You're exactly right Judy! They’re prosecuting under the wrong law, but I suspect they do so purposely so it will more likely result in acquittal, thus not subjecting the invader to the full consequences of breaking the law.

I guarantee you an American citizen would not be spared the wrath of suffering the full legal consequences of his actions, if they were to pass themselves off as someone they were not in order to get a job.
