Former Buffalo Sabre Matthew Barnaby is facing a slew of legal issues after his latest arrest. Barnaby was charged with DWI, a misdemeanor, early Monday morning.
Earlier this year, Barnaby was arrested and charged with threatening his estranged wife's friend. He pled not guilty and was sentenced to community service. Harassment charges from that case were expected to be dismissed if Barnaby completed community service and stayed out of trouble for a year, but now Erie County District Attorney Frank Sedita tells Eyewitness News that Barnaby could face those charges.
And legal experts say Barnaby, a Canadian citizen, could be deported from the U.S. "He may be deported if it is found that he committed moral turpitude," attorney Barry Covert, of the law firm Lipsitz, Green, Scime, Cambria LLP .. , stated on Eyewitness News.
Covert explained that Barnaby was granted deferred prosecution in the domestic violence case by District attorney Frank Sedita. “They didn't want him to have a problem, in this instance, to get back into the U.S. that if he left and visited his parents in Canada that he may have a problem reentering. They may not allow him past the border,â€NO AMNESTY
