    Doņa Ana County commissioners seek 'clear policies' on immigration enforcement

    Commissioners OK resolution in 4-1 vote

    LAS CRUCES >> Doņa Ana County commissioners OK'd a measure asking for a "clear policies" that ensure local authorities keep out of the business of enforcing federal immigration law.

    The resolution — a non-binding, formal stance by the commission — was cheered by a number of attendees with the Border Network for Human Rights.


    At an April 8 county commission meeting and subsequent public demonstration, the group had alleged the Doņa Ana County Sheriff's Office was enforcing federal immigration law. The sheriff's department countered the allegations, saying it doesn't enforce immigration statutes.


    The county commission resolution, approved 4-1, doesn't mention the sheriff's department by name, but indicates support for several steps, including the "establishment of clear policies that leave enforcement of immigration laws to federal agencies." The resolution urges "local jurisdictions and local law enforcement entities throughout Doņa Ana County to do the same," according to the document.


    County Commission Chairman Billy Garrett said the commission's formal stance was to promote building trust in law enforcement agencies. He said the resolutions's language was "pretty straightforward."


    "What's been called for is a clear policy to make sure everyone understands it," he said.


    The Border Network for Human Rights' Executive Director Fernando Garcia repeated to commissioners the group's concerns about local law enforcement asking about a person's immigration status. He said it undermines undocumented immigrants' trust in law enforcement and keeps them from reporting crimes such as domestic violence.


    Doņa Ana County Sheriff Todd Garrison wasn't available Tuesday for an interview, but department spokeswoman Kelly Jameson rehashed the agency's stance.


    "Sheriff Garrison has maintained that our deputies do not act as federal agents, nor are they trained to perform the duties of federal agents," she said in a statement. "Our office is currently rewriting all departmental policies as part of an accreditation process, and it is likely that updated — and perhaps more clear — policies on this issue will be rewritten anyway."


    During the public meeting, Commissioner David Garcia addressed attendees in Spanish, drawing loud applause. Garrett asked Garcia to relay that applause wasn't allowed in County Commission meetings.

    Attendees also weren't allowed to hold up posters.


    Commissioner Leticia Duarte-Benavidez told attendees she supported the resolution.


    "I want you all to be able to go to law enforcement when it is necessary," she said.


    County Commission Ben Rawson voted against the resolution.

    Earlier this month, the Border Network for Human Rights delivered thousands of petition signatures to county officials, urging Garrison to take four steps, which included instructing deputies to stop asking about immigration status or for Social Security numbers during routine traffic stops.

    Commissioner Wayne Hancock said he viewed Tuesday's resolution as an "issue of human rights."


    "My belief is that human rights of one affects the human rights of all of us," he said. "I support this issue strongly because everyone should feel safe in their community."
