    BISBEE — A southern Arizona rancher known for detaining illegal immigrants continues to challenge a $98,775 judgment awarded in a lawsuit against him.
    The Arizona Court of Appeals, in a ruling released this week, upheld the judgment, which was awarded to a group of deer hunters Roger Barnett found trespassing on his Douglas-area ranch in October 2004.
    A lawsuit filed on behalf of the group, which included three young children, alleged Barnett threatened the five with an assault-type rifle, as well as battery, false imprisonment, negligence, gross negligence and intentional infliction of emotional distress.
    David T. Hardy, who is Barnett's attorney, said Thursday that he would appeal the appellant court ruling to the Arizona Supreme Court.

    Gee maybe if the illegal aliens hadn't been trespassing, they wouldn't have angered this man.

    Witnesses? Nothing mentioned about witnesses except for the lying illegal aliens.

    Once again it appears it's a their word against a legal citizen.

    this should be taken all the way to the supreme court if needed.A man in my area found a man on his wooded property dumping brush,when he let his guard down the man tried to hit him with his truck he had hauled the brush in.If they were dear hunting then they had guns on his property and were in dangering thier own children.Anyone who deer hunter know you are at risk at being shot accidently by other deer hunters who do not know anyone else is hunting or allowed to hunt on that private property

    Also do not understand why any judge would not understand that people hunting on your property without permission are endangering owners or anyone with a stray bullet.I would be more careful going out on my property if I had given someone permission to hunt on my property.The game warden in my state of NC will take your firearms and yuor vehicle and handcuff you for hunting without license,especially if you do not have WRITTEN permission

    TUCSON, Ariz. (AP) - A federal judge has denied a southern Arizona rancher's motions to dismiss a civil lawsuit on behalf of illegal immigrants who alleged that he detained, assaulted, battered and threatened them.

    U.S. District Judge John Roll ruled that there was sufficient evidence for a reasonable jury to find in favor of 16 men and women who sued Roger Barnett.

    Barnett has gained notoriety for detaining thousands of illegal immigrants on property he owns or holds grazing rights to.

    The lawsuit also named Barnett's wife and brother.

    Last month, a state appeals court denied Barnett's appeal after a jury found him liable for assaulting a family of Mexican-Americans who were hunting on state land near his ranch.

    Attorney David Hardy, who represented Barnett on the appeal, did not immediately return a call for comment Friday.

    Si if I read this right, you can virtually hunt anywhere you want in Arizona, if you own land you have NO RIGHTS and anyone can hunt. Are people's cattle safe? Where I live you have to have written owner permission to hunt on their land, or maybe if ILLEGALSwant to hunt on my land I would have no say so, guess I need to call someone to see what my AMERICAN LAND OWNER rights are.

    I suppose this will turn out to be another case like one several years ago.

    A rancher shot and wounded two illegal aliens who broke into his home, they sued and now own his ranch.

    According to the story I read, after the victory the 2 jubilant new landowners were happily making plans to open the ranch to their extended family and friends "seeking a better life".

    I couldn't believe it.
