Judge won't delay hearing on English learners

A federal judge is refusing to delay the next round of a hearing on whether Arizona school programs for students learning English now comply with federal mandates on equal opportunities in education.

Superintendent of Public Instruction Tom Horne had asked for the delay, saying his current lawyers won't be available to resume the hearing in January.

U.S. District Raner C. Collins denied the request without comment.

A previous judge ruled in 2000 that the programs were inadequate, but the U.S. Supreme Court ruled in June that Arizona is entitled to a fresh review.
