Eagle County schools ignore students’ status

EAGLE COUNTY, Colorado — School leaders can tell you how many students can’t speak English in Eagle County, but what they don’t know is how many of those students are here illegally.

A student’s legal status is not something schools are allowed to ask when they’re registering for classes, said Dick Lyons, an attorney for the Eagle County School District.

A 1982 Supreme Court decision, Plyler v. Doe, ruled that undocumented children and young adults have the same right to attend public, kindergarten through 12th grade schools as United States citizens.

Therefore, schools aren’t allowed to deny any child an education because they’re in the country illegally, and schools aren’t even allowed to ask.

“Our job is to educate whoever is in front of us. We can’t differentiate.â€

Not a dictatorship after a fashion? NINE people sit and tell 300 MILLION what they can and cannot do, without question!!! NINE people make Islamic terrorists U.S. Citizens, at least as far as rights, rights that our own military men don't have. NINE SUPREME people bind the hands of States and their soverignity dictating to them. With their decisions they load a giant burden on education and hospitals. I seriously doubt they had the vision to foresee what is taking place. They obviously thought it would be a handful of illegals when these decisions were made. Times have changed and so should the decisions, especially the one about birthright citizenship.

Sorry, but we will never stop or control illegal immigration until that 1982 Supreme Court decision is overturned, Pyler vs. Doe.

It amazes me that people don't get it: Illegal immigrant parents don't just come to the U.S. to pick crops or to work in hotels for meager wages.

They come mainly so that their children can find a better life than can be found in places like Mexico.

And this better life starts with the great U.S. public education system.

Yes, I know that many out there say that in many areas our public education system is terrible.

But those who complain about our public education system must remember this: Any type of American education is so much better than an education that many of these parents can hope to give their children in places like Mexico, Guatamala, Honduras, and other countries in Latin America.

A good babysitting system: Even if the school system is poor in some states, at the very least, it is a great babysitting system for an illegal immigrant parent working in the field or at a hotel during the day.

So as I see it, somehow, some way we must overturn that 1982 misguided Supreme Court ruling where illegal alien children have FREE access to American public schools.

Many people talk very seriously about trying to overturn Roe vs. Wade, the ruling concerning abortions in the U.S.

Well, I say this: The same energy and hard work that people put in
trying to overturn Roe vs. Wade must by applied in trying to overturn
the 1982 ruling that turned our public schools system into FREE babysitting
    institutions for illegal immigrant children.

Your right! Plyler v. Doe was terrible decision and has had devastating consequences. To hold that someone who entered this country in violation of Federal immigration law would have the same rights and oportunities to an education as an American citizen is absurd. The supreme Court failed miserably to uphold the Constitution and protect this country with that decision. This was an insult to the spirit for which the Constitution was founded upon.

A free public education is one of the magnets that attracts illegals to this country, even if it's only being used in many cases as a free "babysitting service," which is too often the case with these people.

Unfortunately, pro-illegal invader advocates (especially those in the LAUSD) absolutely love this decision in which a day does not go by in which they remind us, " every child has the right to an education regardless of their immigration status!"

I agree. They have a right to an education, just not in this country. Go take up that fight in our own countries!

I'm aware that the liberal SCOTUS says taxpayer funds must be used to educate illegal aliens in our socialized government schools. But I'm not aware that they ruled we cannot ask. Is that another liberal extension of the language? This is an infuriating imposition of socialist doctrine on all citizens and saddles them for their entire lives with a crippling and unfair cost. I'd recommend the schools be required to use the E-Verify Program to determine citizenship. If it's not used to deport illegal aliens, as designed, at least it would permit calculation of the total aid expended on Mexico and Latin America.

They sure asked me when I enrolled my kids! I had to prove everything with SS#'s and birth certificates and shot records, utility payments, rent or mortgage papers, and all or else they would be denied and I would be charged with neglect.

School taxes are paid by homeowners and that is based on footage and how many potential children there might be (I had been told). Knowing who these kids are are how they determine when a new school needs to be built and all that. Estimated guesses on poplulation growth etc. You can't just have a bunch of people migrating at will and expect each district to be able to handle massive invasions without a serious loss of things for the children of citizens who pay for this.

I understand the teachers delima of not being able to police everything....but to say they aren't allowed to ask, when anyone with kids in school knows they do......I don't get. No, the teacher didn't ask, an office person did. Dr.s may have to treat emergency patients in the hospital, but don't tell me they don't ASK a ton of questions of where to go and what to do or where to send you to apply for aid in order to get payment for these services. Not the Dr. but someone from admissions did and someone from the financial department scrapes up even more to track you down.

I can't stand this helpless thing of we can't ask, because all citizens know they do and they know they have to produce whatever proof is required.
