SEATTLE (Washington) A man whose 7-month-old son died in a fire pit at the family home in Federal Way has been charged with second-degree manslaughter.
King County prosecutors allege in papers filed Friday that 38-year-old Alberto Chacon Rios had been drinking and fell asleep while holding the baby near the fire pit last Sunday.
The King County medical examiner’s office said the baby - Diego Rios Santana - died of smoke inhalation and burns over 100 percent of his body.
Rios is scheduled for arraignment July 9 at the Norm Maleng Regional Justice Center in Kent. His bail is set at $1 million.
Second-degree manslaughter alleges that an unintentional death resulted from negligent behavior by the defendant. If convicted, Rios faces a standard sentencing range of 21 to 27 months in prison.
Prosecutors said they sought the high bail because Rios is an illegal alien who has been deported three times to Mexico and would be held for deportation again if released, making it difficult or impossible to prosecute him.
