Federal court won’t dismiss racial profiling case against Arpaio, but won’t make it into class action
Phoenix Business Journal - by Mike Sunnucks

A federal court in Phoenix on Friday refused to dismiss a racial profiling case against Maricopa County Sheriff Joe Arpaio and his immigration raids. However, the court also declined to give the case class action status, as pushed for by the American Civil Liberties Union and other anti-Arpaio groups.

The suit centers on the MCSO’s immigration and crime sweeps, including arrests of day laborers and raids on businesses. Plaintiffs claim the Sheriff’s Office unfairly targets and profiles Hispanics. Arpaio disagrees.

    Small victory for Arpaio
    by Sandra Haros/KTAR (August 28th, 2009 @ 3:30pm)

PHOENIX - A Federal Judge ruled in favor of Maricopa County Sheriff Joe Arpaio in a racial profiling case Friday.

The judge refused to grant class action status for a lawsuit filed by the ACLU, claiming the sheriff had been racially profiling Latinos in his crime sweeps.

The ruling limits the lawsuit to a handful of plaintiffs rather than expanding it to include almost every Latino resident in Maricopa County.

The ruling is a major blow to those trying to prove that Arpaio and his deputies have been profiling Latinos during saturation patrols.

So what the h--- is wrong with "profiling?" It is the accepted third leg of the triad of criminal investigation. 1. Clues 2. Criminology 3. Profiling.

I think they need to get someone with an Associates Degree (2 yr.) in Criminal Science to set them straight if they think profiling is wrong. This is an overworked accusation from the fringe group of our society that wants to attack law enforcement efforts.

In the sweeps, there could be plenty of illegal Russians or Greeks or Arabs or, or, or... also caught up. Funny how the sweeps only clean up Hispanics. Why are the Hispanics screaming? They scream loudest about the sweeps as they are the most illegal prevalent problem, perhaps.

Ironic isn't it? I guess if one gets robbed, killed, molested, et al; no descriptions of the criminal should be broadcast? Woooo it's a free for all for criminals! Wouldn't that hurt law enforcement and the community more than enforcing the laws against illegal immigration and other criminal acts?

As it stands, the case involves MCSO’s treatment of Manuel De Jesus Ortega Melendres in 2007 in Cave Creek. Melendres says he is a Mexican national who is in the U.S. legally, and he claims he was unfairly detained by Arpaio’s deputies.

How was he "unfairly" detained if he's illegally in the US and admits it? Isn't the point of enforcing immigration laws to detain illegal aliens and process them for deportation (after finishing their sentences?). What a complete waste of time and taxpayer dollars!!

    miguelina...please read this more carefully

When the police do a sweep of course there are some msitakes; that doesn't mean that the person had their life ruined. This person should get over it and go home.....to Mexico if his claim of legal presence in the US is BS. He should have a passport to prove it...or visa...or whatever they use for legal travel
