Federal Judge Dismisses Texas' Lawsuit Over Syrian Refugees

By PAUL J. WEBER, ASSOCIATED PRESS AUSTIN, Texas — Jun 16, 2016, 2:49 PM ET

Texas can't keep out Syrian refugees, a federal judge has ruled, dismissing concerns state Republican leaders' sounded over hidden extremists following the Paris attacks and revived this week by Donald Trump following the nightclub massacre in Orlando, Florida.

Texas was the first state to sue the Obama administration over resettlements, though nearly 30 states vowed to ban Syrian refugees after the Nov. 13 attacks in Paris killed 130 people. But U.S. District Judge David
Godbey threw out the lawsuit in an order signed Wednesday, ruling that Texas had no authority over resettlements that are handled by the federal government.

Similar challenges by other states have also sputtered: Indiana's attempts to bar state agencies from helping Syrian refugees have been blocked by a federal judge, and the Obama administration is seeking dismissal of an Alabama lawsuit that is nearly identical to the one filed in Texas.

"This ruling is a strong rebuke of unconstitutional efforts to block refugee resettlement. It sends the clear message to other states that such attempts are not only un-American, they are contrary to the law and will fail in court," said Cecilia Wang of the American Civil Liberties Union, which represented a nonprofit resettlement organization in the Texas case.

Republican Texas Attorney General Ken Paxton said the state is now considering its options.

"I am disappointed with the court's determination that Texas cannot hold the federal government accountable to consult with us before resettling refugees here," Paxton said.

The Obama administration says refugee vetting is rigorous and can take up to two years.

Trump, the presumptive Republican presidential candidate who has renewed his call for a temporary ban on Muslim immigrants following the Orlando shooting, supporters at Wednesday in Atlanta that the United States is taking in thousands of refugees when they "don't think like us" and we don't know "who the hell they are."

CIA Director John Brennan told a Senate intelligence committee Thursday that the agency has found no connection between the Orlando gunman, who was an American-raised Muslim and pledged allegiance to the Islamic State on Facebook and during a 911 call, and any foreign terrorist organization.

Godbey, who was appointed by President George W. Bush, had previously knocked Texas for offering "largely speculative hearsay" about extremists possibly infiltrating Syrian refugees. In Indiana, U.S. District Judge Tanya Walton Pratt has said Gov. Mike Pence's order denying state help to Syrian refugees "clearly discriminates" against refugees from the war-torn country.

I don't think they're arguing the cases on the right argument. They need to argue it on Constitutional grounds, the lack of federal authority to admit any immigrant into the United States, because there is no power or authority given the federal government to do such under the Constitution, which conversely states that the States decide immigration issues, balanced by the authority of the federal government to prohibit immigration after the year 1808 or tax it prior to.

Our Constitution would need to be amended to allow the federal government to do what it's done with regards to immigration. All immigration authorized and permitted by the federal government has been unconstitutional. That's just a simple fact.

Article I, Section 9. US Constitution.

    Section 9.

The migration or importation of such persons as any of the states now existing shall think proper to admit, shall not be prohibited by the Congress prior to the year one thousand eight hundred and eight, but a tax or duty may be imposed on such importation, not exceeding ten dollars for each person.

The STATES not the federal government are in charge of migration and importation of persons. The Federal Government's only role was to prohibit it after the year 1808. Separately, the federal government was charged with a uniform naturalization law for immigrants to become citizens, but that has absolutely nothing to do with the migration entry itself, which is solely the rights of the States to admit or not admit. For anyone with 2 live brain cells still connected to believe for a second that immigration is a "federal responsibility" is someone too stupid to be involved in the discussion or someone deliberately violating the Constitution of the United States.

So all the phony "Constitutionalists" in Congress like Ted Cruz and "Constitutional Scholars" like Barack Obama are all as guilty as sin for the mess they have created in this country by approving green cards and visas in the millions and allowing Presidents to flood our country with foreign nationals stealing our jobs and educations while running up the debt from the poverty they create.

So start calling a spade a spade. If you're a Constitutionalist, then you are supposed to OPPOSE ALL immigration incited, permitted and funded by the federal government, because it's ALL ILLEGAL and has always been ILLEGAL.

DEMAND OUR GOVERNMENT UPHOLD THE CONSTITUTION.

DEMAND A 20 YEAR MORATORIUM ON ALL IMMIGRATION so we can sort out this frigging mess created by a bunch of liars, traitors, thieves and imposters who call themselves "Presidents", and "Senators" and "Representatives" and perhaps worst of all "Federal Judges".
