State police say the man who caused a fatal crash on Route 42 this week is an illegal immigrant.
Police also say Augustin Garcia-Alcantar has faced deportation before. Garcia-Alcantar is charged with vehicular manslaughter.
Police say he was driving drunk Wednesday morning on Route 42 in Augusta County, when his truck swerved and hit a van. The accident killed one man, and sent six others to the hospital.
Police say Garcia-Alcantar will face a local trial, then deportation.

Fair Punishment for Illegal Immigrants

An illegal immigrant has been named the suspect in a deadly crash that happened last week in Augusta County.
Augustin Garcia-Alcantar still needs to go before a judge on the criminal charges, but the ultimate decision about his deportation will be up to federal authorities.
State police say they've seen more and more illegal immigrants in the Augusta County area. Usually, if police try to pull them over for a traffic violation, illegal immigrants will elude punishment through a legal loophole.
VSP Trooper Tim Simmons says, "It is highly likely that they will not be punished or held accountable for that traffic offense just for the mere fact that there's not tracking system once you release them to apprehend them or punish them for the traffic violation."
A handful of police departments receive training from Immigration Control Enforcement on how to deal with illegal immigrants. Those that don't gt that training have their own way of training officers.
Staunton Police Department Cpl. Kristie Siron says, "They're given training on licenses to tell what may be fake and what may not be and then from there if they have any concerns or questions about what they're looking at, they contact ICE immediately."
While the ultimate decision about their fate is left to federal authorities, state police are working hard to make sure illegal immigrants who commit a crime will pay for it.
"If it's a criminal offense, they'll be taken into custody. They'll be held without bond until a judge decides to release them on bond or not," says Simmons. "That's when the feds are contacted. ICE, Immigration Customs Enforcement gets involved, and they can put a detainer on the illegal alien and decide if they want to come pick them up or not."
Simmons says while a few troopers have been through the intense six week ICE training course, it is the hope of the state police that all troopers and local law enforcement will have the proper tools to detain an illegal immigrant and hold them accountable for their actions.
