Police nab man accused of assault

DULUTH - A man police say has a penchant for assaulting his child's mother finds himself behind bars and awaiting possible deportation.

Emil Aguilar, 18, was arrested early Monday morning after police responded to an apparent domestic incident at the woman's Gwinnett Square Circle apartment.

According to reports, 21-year-old Abigail Tapia returned home from a Mexican Independence Day celebration to find Aguilar waiting near her door. When Tapia told Aguilar she needed to put her kids to bed and didn't want to talk, police said, Aguilar forced his way inside the home.

Tapia told police that Aguilar demanded to talk to her about their relationship and that he pushed and choked her in efforts to get her to hear him out.

When Tapia was able to escape and lock herself in the children's bedroom, according to police, Aguilar kicked the door in and dragged her by her legs.

At some point during the alleged altercation, Tapia was able to call 911 and whisper to authorities that "her baby's father was in the house and was hitting her," a responding officer wrote.

When officers arrived, police reportedly found Tapia frantic and in fear for her life. Aguilar, according to reports, said nothing happened and that Tapia was "just (expletive) tripping."

After officers spoke with Tapia's 6-year-old son and observed red marks and scratches on Tapia, reports said, they arrested Aguilar and charged him with battery and third-degree child cruelty. He was also booked on outstanding aggravated assault and discharging a firearm on another's property warrants, which police said stemmed from an earlier altercation with Tapia.

Aguilar, a Honduras native, is being held without bond at the Gwinnett County Jail and is also on immigration hold.
