Governor Greg Abbott Lays Down A Marker: Texas Will Deport Invaders

Governor Greg Abbott has been talking tough on the invasion from Mexico.

Much of that has been just that, talk. He has taken action though, barbed wire, gun boats, and shipping containers line the Rio Grande, even a floating barrier in the middle of the river. However, aliens are bypassing the barriers, the Border Patrol is cutting barbed wire, entering through open gates, and invaders are just crossing in areas without barbed wire. Large groups are zerg rushing with no opposition.

However, recent events are forcing Governor Abbott’s had. Previously he said Texas would take invaders back to the Ports-of-Entry and, well, it was not clear, force them back through the border gate to Mexico. That did not happen. Word is that the Biden Regime threatened to prosecute Governor Abbott or any Texas official who deported an invader.

Governor Abbott backed down on this deportation plan, but went through with the barriers. But now Governor Abbott is returning to arrests and deportation, perhaps a version of push-back or declaring the invaders after capture as prisoners-of-war (POW) and expelling them.

He could also declare the invaders as illegal combatants and war criminals outside protection of the Geneva Convention, therefore amendable to immediate removal from the battlefield.

Greg Abbott Draws A Line In The Sand

The Tweet by Governor Abbott implies that further action will be taken beyond barriers. Governor Abbott attached a letter invoking State authority to repel invasions, but the letter is from 2022. The letter specifically says that Texas will be removing invaders in some fashion.

By opening our border to this record-breaking level of illegal immigration, you and your Administration are in violation of Article IV, § 4 of the U.S. Constitution. Your sustained dereliction of duty compels Texas to invoke the powers reserved in Article I, § 10, Clause 3, which represents “an acknowledgement of the States’ sovereign interest in protecting their borders.” Arizona v. United States, 567 U.S. 387, 419 (2012) (Scalia, J., dissenting).

Using that authority, Texas will escalate our efforts to repel and turn back any immigrant who seeks to enter our State at a border crossing that Congress has designated as illegal; to return to the border those who do cross illegally; and to arrest criminals who violate Texas law.

With this re-Tweet of the earlier letter, is Governor Abbott now going to start expelling invaders as illegal combatants and POWs? This will create a Constitutional crisis. It will be the first time that a Governor has declared that it is subject to a foreign attack and is invoking his Constitutional powers to repel an invasion.

The response we can expect from Biden and the unindicted visa fraudster Alejandro Mayorkas is an arrest of Abbott. The only problem though is that any prosecution will be in the 5th Circuit Court Of Appeals and while there might be a Federal District Court judge in Texas that will go along with a criminal case, the Appeals Court will not.

The key for Governor Abbott, if he has the courage to actually begin removing invaders, is that it cannot be called a deportation, it must be worded at every level that the invaders being detained are POWs, illegal combatants, and war criminals, therefore subject to being removed from the battlefield, i.e. being returned to Mexico.

A further suggestion for Abbott is to close the bridges on the Rio Grande. Those bridges are under the jurisdiction of Texas and punishing Mexico and Mexicans is the only way, aside from military action along the river, that will force Mexico to end the invasion.

It looks like things might get interesting.
