(Aug. 15, 2017) A 27-year-old Guatemalan national detained on Nantucket was indicted in federal court last Thursday on a charge that he returned to the United States illegally after being deported.

Jary Vincente Valenzuela, who was charged with one count of unlawful re-entry of a deported alien, had an encounter with law enforcement officers on the island July 26 and was determined to be in the country illegally, according to a statement from the U.S. Department of Justice.

He had been deported from the U.S. on Aug. 8, 2013, according to the statement.

Valenzuela faces a sentence of no more than 20 years in prison, up to three years of supervised release, a fine of $250,000, and will be subject to deportation proceedings upon completion of his sentence.

There are three tiers of sentencing guidelines for the charge Valenzuela faces, based on the seriousness of the defendant’s criminal history. Valenzuela faces the highest possible sentence for the charge, according to Kristina Mastropasqua, a spokeswoman for the Department of Justice.

The department released no further information, including Valenzuela’s prior criminal charges and the number of people on the Cape and Islands who have been charged with unlawful re-entry of a deported alien.
