H.R. 3842, Deny Funding for Lawsuits Against Immigration Enforcement Laws
Issues: Immigration
According to the Department of Homeland Security’s Office of Immigration Statistics, about 10.8 million unauthorized aliens were living in the United States in January 2010. The economic and public safety consequences of this alien population are far-reaching. While the Obama Administration has failed to take sufficient action to address our nation’s illegal immigration crisis, state governments have chosen to move forward with their own immigration enforcement laws.
Perhaps most famous is Arizona’s SB 1070, a law that would require state and local law enforcement officials to facilitate the detection of unauthorized aliens in their daily law enforcement duties, as well as establish criminal penalties under state law for alien smuggling and failure to carry or complete alien registration documents. States such as Alabama, Indiana and South Carolina among others have also put forward their own immigration laws to address the illegal population in their states.
In 2010, the Department of Justice (DOJ) filed suits against Arizona to halt the state’s enforcement efforts, claiming SB 1070 preempted federal immigration law. Since then, DOJ has entered into lawsuits against various other states.
A September 29, 2011 article in The Washington Post regarding these law suits noted that:
"The level of federal intervention is highly unusual, legal experts said...Typically, the government filesbriefs or seeks to intervene in other lawsuits filed against state statutes."The federal government should not stand in the way of states seeking to enforce their own laws in order to uphold the law and protect their own citizens. Our very system of government was founded upon a shared power between the federal government and the states. The U.S. Constitution specifically gives broad authority to individual states. States must be able to address this problem that the federal government has only neglected.
This is why I am introducing legislation to prohibit President Obama’s Administration, including the DOJ and other agencies, from using federal funds to sue states over recently passed immigration laws.
This legislation prevents funds for lawsuits regarding specific laws passed in Alabama, Arizona, Georgia, Indiana, Missouri, Oklahoma, South Carolina and Utah.
While the Supreme Court will take up the Arizona case during this year’s session, Congress must assert its authority by withholding funds from DOJ to stop these political lawsuits.

I wish they would stop all of the grants that these agencies are pumping out of the door. They give away billions of dollars to pick their winners and losers and then sue the states that don't agree.
