Holder: U.S. to watch Arizona for racial profiling

WASHINGTON (AP) -- The Justice Department hasn't ruled out filing a second lawsuit challenging Arizona's immigration law if evidence shows racial profiling at work, Attorney General Eric H. Holder Jr. said.

The Obama administration sued Arizona last week, arguing that the state is impinging on federal responsibilities for dealing with immigration. The state law requires police, while enforcing other laws, to question a person's immigration status if there's reasonable suspicion the person is in the country illegally. It also requires legal immigrants to carry their immigration documents.

The suit didn't deal with concerns about racial profiling so that it could focus on the most serious problem with the law, Mr. Holder said in an interview broadcast Sunday on CBS' "Face the Nation." In six months or a year, his department might look into the law's impact on racial profiling, he said.

"If that was the case, we would have the tools, and we would bring suit on that basis," Mr. Holder said.

Arizona Gov. Jan Brewer, who defends the state immigration law as constitutional, said she believes federal officials would have included racial profiling in the suit if they thought it was an issue.

"Why would they have to hesitate, after all the comments they made and all the outrage that they made against the bill in regards to racial profiling, that it didn't show up?" Ms. Brewer told the Associated Press during a break in the National Governors Association meeting in Boston.

Ms. Brewer said she is confident that the state law can be enforced without racial profiling, which she acknowledged is against state and federal law.

"The bottom line is that people in the Southwest, particularly Arizona, we love our diversity. It's in our DNA. We are almost, I believe, colorblind," she said. "It's just not in us. We've grown up; we've lived next door; we work together; we eat together. I mean, it's so different than the issues they always want to relate to the South, you know, in regards to the civil rights issues down there."

    Illegal,Immoral or Unethical

Mr. Holder, Sir please be advised we will be watching you and your boss, Mr. Obama for anything you might be doing that is illegal, immoral or unethical. And Sir we will inform the whole world about your attacks on the American people and the Constitution while letting people like the Black Panthers who threaten lives of citizens go free from prosecution. You Sir, and I use the term loosely are an OBAMANATION as is your boss. You and he are truly UN-American and betrayers of America and are only promoting your agenda for voters for your party.

Holder Floats Possibility of Racial Profiling Suit Against Arizona

    Published July 11, 2010

Attorney General Eric Holder, just days after filing a federal lawsuit against Arizona's immigration law, on Sunday floated the possibility of filing another suit on racial profiling grounds.

The lawsuit filed Tuesday in U.S. District Court in Arizona claimed the state was infringing on federal immigration responsibilities and urged the judge to prevent the law from going into effect at the end of July. Despite some officials' claims that the law could lead to racial profiling, that concern was not cited as grounds for the suit.

However, Holder said on CBS' "Face the Nation" that the federal government was leading with its "strongest" argument in the suit filed Tuesday and would not rule out a second suit months down the road -- if the law ends up going into effect.

"It doesn't mean that if the law for whatever reason happened to go into effect, that six months from now, a year from now, we might not look at the impact the law has had ... and see whether or not there has been that racial profiling impact," Holder said. "If that was the case, we would have the tools and we would bring suit on that basis."

Holder, reacting to the firestorm of criticism from Republicans and border-state lawmakers, said the Justice Department decided to file the suit because Arizona's immigration law is "inconsistent" with federal policy and the U.S. Constitution. He said there's nothing to stop local jurisdictions and states from helping the government enforce immigration law, but described Arizona's law as contradictory to what the federal government is trying to accomplish.

The law makes illegal immigration a state crime. It requires local law enforcement to question anyone they suspect of being an illegal immigrant on their immigration status -- provided they don't stop them for that reason alone.

Sen. Jon Kyl, R-Ariz., disputed Holder's characterization. Speaking on "Fox News Sunday," he said Arizona's law is trying to help, not hinder, the federal government's immigration efforts.

Illegal immigration has nothing to do with "racial profiling". I wouldnt doubt it if Holder planted some people to claim they were racially profiled.
