It's only a felony if you have been previously deport, not if you returned voluntarily. That's why the volunteer to return to their home country rather than go to court.

This is nothing more than the globalists attempt to throw us a bone. For one to break into this country, without permission, without immunization requirements being met, stealing social security numbers from citizens and not reporting their FICA, they should serve time and then booted outa here in a heart beat. But no, these aren't considered serious crimes by our government..This government is whacked.

Ms. Janet Napolitano is now, and always has been, a supporter of comprehensive immigration reform (amnesty). I'm sure her new position will not change what's in her heart. I believe William's right, she has no interest in deporting illegal aliens unless they're considered hardened criminals. IMO, we went from bad to worse when Napolitano replaced Chertoff.

You are right. Our country is already on the path of ruin. Obama has chosen CRIMINALS and open border fanatics for positons in our government. IMO he is one of the strongest backers of globalism and new world order this nation has ever elected. And IMO he isnt even qualified to be our president.

Which criminal aliens? According to federal law, ALL illegal aliens are criminals, so let's get them all out of the USA.

The Justice Departments definition of a criminal alien is:

"Generally, criminal aliens are considered to be noncitizens who are residing in the United States legally or illegally and have been convicted of a crime."

So legally they are not a criminal alien until they have been CONVICTED of a crime.

So legally they are not a criminal alien until they have been CONVICTED of a crime.

That's right and crossing the border is a civil offense not a criminal offense that is why Sensenbrenner wanted to make it a felony with his bill (4437) that of course did not pass....so it is a civil offence (misdemeanor)

But once they have been arrested and given a date to appear in immigration court they are held responsible, if they do not show up in court they lose the right to another hearing and are deportable, if they are told to self deport and do not it is a felony, 2nd offence of entering the country is a felony and a criminal offence ....

Its called Due Process, and it is crap but until the penalty for the first offence gets changed a judge can even allow them to stay if at the hearing he thinks they are fit to live in the United States regardless of the means they used to get here.

Bottom line we really needed H.R.4437

Ditto! They are ALL criminals if they have entered this country in violation of Federal immigration law and need to be deported! The fact that Napolitano would make such a distinction would seem to suggest she doesn't believe those who have merely entered the country illegally are actually criminals.

Atleast, that's the perception created! It was have been just as easy for her to say that those who are in this country illegally need to return to their countries of orgin, or risk being apprehended and deported!

When are we going to get someone appointed to Head of Homeland Security WHO ACTUALLY BELIEVES IN THE RULE OF LAW AND HAS A DESIRE TO DEFEND THIS COUNTRY AND DEPORT THOSE WHO HAVE ENTERED ILLEGALLY( Answer:The day we elect a President who is actually committed to defending our border and sovereignty )!

As head of Homeland Security, her goal should be to remove ALL illegal aliens, including those who have committed crimes in addition to being here illegally! She should not have to apologize nor worry about the PC police for saying or believing that either ! Somehow, I suspect she has a soft spot in her heart for illegal invaders....
