ICE releases man charged in deputy's death

04:48 PM CDT on Tuesday, April 29, 2008

By Juanita Jimenez / 11 News

HOUSTON -- The man charged in the death of a local deputy has been released from ICE custody.

    Harris County SO

An autopsy report included pathological findings that Deputy Craig Miller, a 20-year veteran of the Harris County Sheriff's Office who died in an auto accident while on duty, suffered from acute alcoholism
Jose Jesus Vieyra was apprehended after an undercover Harris County Sheriff’s deputy died when he hit the commercial truck Vieyra was driving.

Tests show that Deputy Craig Miller’s blood alcohol level was about three times the legal limit when the accident occurred in February.

An autopsy indicated the deputy was drunk at the time of the crash.

Still, Vieyra was charged with criminally negligent homicide. Investigators say he caused the accident because he was trying to cross several lanes of traffic at the time.

They say Vieyra was in the country on a 2006 visitor’s visa. Federal immigration officials say it had expired.

Vieyra is expected to go to court Wednesday morning.

That must mean he was sent back to the county jail, instead of being held at an ICE facility. They're not going to let somebody out free on a homicide charge. (Just everything else up to it! )

What law school did you go to, anyway?

What other infamous ILLEGALS remained in the United States after their visas "expired" only to fly planes into the W.T.C.?

They expect the ILLEGAL to show up in court, maybe if they already cut a Pro-ILLEGAL deal!

You know what captain, I did completely read over the sentence in which it states he is still being charged with negligent homicide. That's not good on my part as this was a material fact! My bad

Yes, I would have to assume ( shouldn't do that) that he was remanded over to the county to be held until his Wed court date. Atleast I would hope this is the case (unless he was given and posted bond). I wonder why they didn't include that fact in this article though as it would seem rather relevant.

    Sorry for the confusion...
