    Louisville, Ky. (WHAS11) - A man accused of molesting a 7-year-old girl faced an Oldham county judge. Jorge Avila, 21, is charged with two counts of child molestation for a crime that dates back to 2005. He was arraigned in court on those charges Monday.

    This investigation spanned across two states and two years. The alleged victim was 7-years-old when she first accused her mother’s boyfriend of molesting her back in 2005 in Jeffersonville, Indiana. But she withdrew her claim shortly after. But now new evidence has put Jorge Avila behind bars.

    Who cares where he's from as long we get rid of them all. If I had my way I would reopen Alcatraz and start throwing them all in there for this type of heinous crime.

    Accused molester could be deported before trial in Clark County

    Illegal immigrant allegedly gave 7-year-old victim STD

    A man who was scheduled for trial in a child-molestation case next week may be deported before he ever goes before a jury.

    Jorge Avila, 21, of La Grange, Ky., allegedly molested a 7-year-old girl from June 2004 until August 2005 in Jeffersonville and gave her a sexually-transmitted disease.

    Avila was scheduled for trial Tuesday on two class A felony counts of child molesting and one count of class C felony child molesting. But on Oct. 14, Magistrate Bill Dawkins ordered Avila’s release. Because he is an illegal immigrant, he was turned over to Immigration and Customs Enforcement.

    Avila was released because of Criminal Rule 4(A), which states that no defendant shall be held in jail on a charge without a trial for more than six months. He was charged March 12.

    If a trial is delayed because of court congestion or the defendant’s motion to continue, the rule does not take effect. Clark County Deputy Prosecutor Shelley Marble argued that Avila was scheduled to begin trial within the six months, but an older molestation case for a different defendant was on the docket for the same date in Clark County Superior Court No. 1.

    Avila’s public defender, Amber Shaw, filed a motion for release. Because the chronological case summary did not reflect that congestion was the cause of the delay, Dawkins granted the request. Marble filed multiple objections to the ruling and said she provided documentation that she was in court that week working another trial. Dawkins rejected those appeals.

    The victim’s mother said she believes Avila — who is expected to be deported to Mexico — will return to this area. He was deported once before but returned, she said.

    Watched this on news tonight. No one is taking into account that:

    He was deported back to Mexico in 2005 but re-entered the US illegally.
    This mother and daughter might as well get out of town before this guy can get back. We need new government around here badly.

    CLARKSVILLE, Ind. -- A woman who said her daughter was sexually abused by an illegal immigrant is concerned about that immigrant's release from jail.

    Avila was scheduled to go to trial last month, but for the second time since he's been charged with the crime, he's in the process of being deported.

    "My main concern is he knows where we live. He knows where my daughter goes to school," said the mother, who asked to remain anonymous. "I feel like that we have been victimized twice."

    For a brief time, Avila was her boyfriend, she said. While she was at home with her daughter and Avila, over the course of a year, she said Avila molested the girl several times, then threatened to kill her and her mother if she told anyone.

    "She's scared of men in general other than her father and her grandfather," she said. "She's always wondering if he's going to come and get her. She has nightmares."

    According to court records, the girl, who's now 10, contracted a sexually transmitted disease. While in custody, Avila was tested and found to have the same disease.

    But because a judge ruled the Clark County Attorney's Office, due to a case backlog, didn't bring Avila to trial quickly enough, he was released from jail, then picked up by federal authorities to be deported back to Mexico.

    "This is extremely frustrating because this is major," said Clark County Prosecutor Shelly Marble. "This is child molestation; this is something that needs to go to trial."

    "I'm not too happy with them right now," said the mother. "They've been relatively shady about the whole issue. And my feeling is there has to be somebody on that docket that has less of a crime."

    Detective Charlie Thompson, who investigated the case, said the woman and her daughter have reason to be concerned Avila could show up again.

    Thompson said Avila has family in the area and was deported once and returned.

    Thompson also said after his arrest, Avila told police if he's deported again, he'll come back again.

    "I just hope and pray that he doesn't come back and do this to somebody else's children," said the mother. "I mean, I would love for us to be able to have our justice."
