    and rapist gets
    six to 12 years

    By William Kenny
    Times Staff Writer

On Oct. 1, 2005, illegal alien Francisco Segovia was employed as a traveling repairman for a New York-based video game machine vendor when his job required him to drive to Pennsylvania.
Because of his actions during a stop in Northeast Philadelphia, he’ll be staying in Pennsylvania a lot longer whether he likes it or not. Then he’ll probably be sent back to his native Ecuador, according to a city prosecutor.
Segovia, 33, was sentenced last Thursday to six to 12 years in state prison for raping a local hitchhiker in his service van after spotting the 20-year-old woman walking along Roosevelt Boulevard near Solly Avenue on a rainy night.
Common Pleas Court Judge Albert Snite handed down the standard-range sentence for the man who the judge in November convicted of rape, false imprisonment and related crimes following a three-day waiver trial.
Assistant District Attorney Mark Cipoletti had asked for an aggravated-range sentence of eight to 20 years for Segovia, who waived his right to testify on his own behalf at the hearing.
The victim, now 21, spoke for about five minutes detailing the anguish she has endured as a result of the 1:30 a.m. attack.
According to trial testimony, Segovia offered the woman a ride, which she accepted. The defendant began driving in a different direction than anticipated by the woman. Soon, he parked, tossed her into the rear of the van, punched her in the face, covered her mouth and nose and forced her to have sex with him.
Almost immediately, Segovia apologized to the victim.
In exchange for her freedom, the victim promised not to report the crime. She convinced the rapist to return her purse and cell telephone and to release her at Cottman and Bustleton avenues. She immediately called 911.
Police spotted the van minutes later at Bustleton Avenue and Levick Street and arrested the suspect.
The victim has sought professional counseling for her fears of leaving her home, being alone and meeting strangers, Cipoletti said.
Under the provisions of Pennsylvania’s Megan’s Law, Segovia was not classified a sexually violent predator by the state’s Sex Offender Assessment Board, but he is considered a sex offender. As such, he will be required to register with the Pennsylvania State Police upon his release from prison.
His mandatory reporting may be a moot issue, however, as the U.S. Bureau of Citizenship and Immigration Services (formerly the Immigration and Naturalization Service) is expected to pursue deportation upon his release from state prison.
It wouldn’t be the first time for Segovia.
He was previously deported to Ecuador following a 1993 robbery conviction in Queens County, N.Y. He returned to the United States illegally, Cipoletti said. ••
