    4 More California Members Co-Sponsor Birthright Citizenship Act (Bilbray, Calvert, Campbell & Hunter)

    Reps. Brian Bilbray (R-Calif.), Ken Calvert (R-Calif.), John Campbell (R-Calif.), and Duncan Hunter (R-Calif.) have cosponsored the Birthright Citizenship Act of 2011 introduced by Rep. Steve King (R-Iowa). All four Members signed onto the bill shortly after it was introduced in the 112th Congress. The bill currently has 56 cosponsors and growing and amends current U.S. code to require at least one parent to be a U.S. citizen or legal permanent resident for a new born to receive automatic citizenship.

    The Fourteenth Amendment extends citizenship to all persons born in the U.S. and "subject to the jurisdiction"; it also grants Congress the power to enforce and define the provisions of the amendment.

    Since the Civil Rights Act of 1866, Congress has defined Birthright Citizenship through appropriate legislation, which for decades has granted citizenship to newborns with both parents illegal aliens, foreign tourists or temporary foreign workers and students. The Fourteenth Amendment gives Congress the right to define birthright citizenship differently.

    The Birthright Citizenship Act of 2011 would add to the existing federal code a provision that requires at least one parent of a new born to be a U.S. citizen or legal permanent resident in order for the new born to receive automatic citizenship.

    The United States is only one of two industrialized nations (Canada) to offer Birthright Citizenship.

    I think it is a fair and legal way to view the The Fourteenth Amendment, one parent should be a legal citizen or resident before undocumented aliens birth children gain citizenship in the United States.

    The part of the 1866 Act which is incorporated into the U.S. Code reads, "All persons within the jurisdiction of the United States... shall have the same right as is enjoyed by white citizens..." The 14th Amendment reads, "All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside."

    When questioned about the meaning of the 14th Amendment's citizenship clause, the Amendment's authors were clear about it not pertaining to foreigners, aliens, or the children of diplomats.

    Paragraph 1, which contains the citizenship clause also says that no state may deprive any person of due process. IMO that refers to territorial jurisdiction, not to the full legal jurisdiction which pertains only to citizens and legal residents. We can see support for this interpretation by referring to the Oath of Allegiance which all legal immigrants must swear, to become citizens. The Oath reads in part, "I hereby declare, on oath, that I absolutely and entirely renounce and abjure all allegiance and fidelity to any foreign prince, potentate, state, or sovereignty of whom or which I have heretofore been a subject or citizen." We can of course enforce our laws on our territory, while according the accused full due process. But convicting, incarcerating, or expelling criminals does not transform them into citizens.

    I'd prefer a clarification which requires that both parents be citizens or legal residents, but even requiring that one parent be legal is a big step in the right direction.

    The 14Th Amendment is a Constitutional law that was set in place over 100 years ago to protect slaves, illegal immigrants are not slaves forcefully brought to this Country. Another section of the 14Th Amendment explained by a Supreme Court, if any person freely leaves their homelands and enters another Country, they do not have a legal right to become a citizen in Country where they flee to, so the way it is translated illegal immigrants arrived to the U.S. freely and illegally, therefore the United States has no obligation to make them or their children citizens, due to illegal invasions.

    If parents arrives to a Country undocumented, their birth children are also illegal aliens, because neither parent are legal citizens or residents.

    What about the one illegal parent? Can we deport that one?
