A criminal alien from El Salvador wanted in Santa Barbara, Calif., for aggravated sexual assault and forcible rape of a child under 14 years of age was arrested by federal law enforcement officers, according to a report released by the Homeland Security Department dated Feb. 27, 2013.
Santos Javier Guevara-Oliva was arrested in Hyattsville, Md., by officers of Immigration and Customs Enforcement's Baltimore Criminal Alien Program (CAP) assigned to the U.S. Marshals' Capital Area Region Task Force after he was identified as being a criminal alien who illegally re-entered the United States after deportation, according to Baltimore CAP Director Calvin McCormack.
"This case is evidence of everything wrong with our immigration enforcement in this country. Here's an illegal alien who was convicted of felonies, served one year in prison, and somehow he slips back into the country and rapes a young girl. What does Obama and his appointees have to say to her? Where is her apology? Where's her justice?" asks former police detective Iris Aquino.
"Now we have Obama's people releasing criminal aliens just to score political points against his political opponents," said Aquino.
According to the federal officers in the case, On Feb. 1, 2013, Santa Barbara Superior Court filed state criminal charges against Guevara-Oliva for aggravated sexual assault on a child under 14-years-of-age and for forcible rape.
Detectives from the Santa Barbara Sheriff's Department contacted ICE officials in Santa Barbara after they suspected that Guevara-Oliva was unlawfully in the United States. The federal officers initiated an investigation and determined that Guevara-Oliva is a citizen of El Salvador, who had been deported from the U.S. as an "aggravated felon" in December 2010.
At an unknown place and time, Guevara-Oliva illegally re-entered the United States without inspection and took up residence in the Santa Barbara area.
The continuous efforts and interaction between Baltimore CAP officers, Maryland State Police, detectives from Santa Barbara Sheriff's Department and the Santa Barbara County District Attorney's Office ultimately resulted in locating and arresting the 33-year-old criminal alien.
Investigation revealed his criminal convictions in 2009 in Santa Barbara included grand theft and false imprisonment where he was sentenced to two years in prison. Upon release in 2010, he was deported back to El Salvador.
Guevara-Oliva is currently in custody in Baltimore City pending extradition to Santa Barbara where, if convicted, he faces up to life in prison with no possibility of parole.
