BEAVER MEADOWS – Two area state legislators held a press conference near Hazleton on Monday morning to express their outrage over the federal government’s recent release of an admitted illegal immigrant who was stopped for speeding.

Tlalmis-Perez produced a Mexican voter registration card as identification and had two Pennsylvania ACCESS cards in other names and $3,000 in cash, Morresi said. The man had no job or address and told Morresi that he had lived illegally in New Jersey for five years and in Hazleton for one year.

If the local police had followed up on this "fraud", the feds would have deported him. The local PD failed to follow thru.

The following information was released by Pennsylvania House of Representatives, Republican Caucus:
At a press conference on Monday, May 9, Reps. Doyle Heffley (R-Carbon) and Tarah Toohil (R-Luzerne) expressed their shock and disappointment at how a traffic stop involving an illegal immigrant was handled by Immigration and Customs Enforcement (ICE) officials.
An illegal immigrant was pulled over for speeding in Beaver Meadows and was discovered to be driving without a license with only a Mexican identification card.
He was detained for four hours and released.
Instead of being held for further immigration proceedings by ICE officials, he was driven to the Luzerne County line.
"This is a blatant example of the federal government failing to follow through on local enforcement of national immigration laws," said Heffley.
"This has been going on for far too long and needs to immediately end. Here we have an example of local law enforcement doing its job, detaining a possible illegal immigrant, but ICE officials, instead of detaining the suspected illegal immigrant, drive him to the county border and release him? Toward what end?"
"In addition to being here illegally, this individual had two ACCESS cards which is a very clear indication of welfare fraud," said Toohil.
"Every law-abiding citizen in this country should be personally offended by this situation. The local law enforcement officer did his job but ICE refused to detain the man. What good are the immigration laws we have if federal agencies absolutely refuse to enforce them?"
ACCESS cards are used either to obtain medical assistance, or, if the cardholder also receives cash assistance or Food Stamps, an ACCESS EBT (electronic benefit transfer) can be used to obtain all three forms of welfare.
"We are calling on the federal government to do its job and enforce federal immigration laws in Pennsylvania," the legislators said. "We are in the midst of tough financial times, yet an illegal immigrant who quite possibly was illegally receiving welfare payments was let go with only a cursory investigation. It's high time we put a stop to this. This is why we have signed on to the National Security Begins at Home package of immigration reform bills and support welfare reform."
The legislators are calling on Congress, the U.S. Citizenship and Immigration Services of the Department of Homeland Security, and the Obama administration to take immediate action to detain, investigate, and when appropriate, initiate deportation proceedings when any illegal immigrant is discovered during any traffic stop, immigration enforcement procedure or criminal investigation.

Released illegal immigrant had record

An illegal immigrant taken into custody after a traffic stop in Beaver Meadows on May 2 but released on orders from federal Immigration and Customs Enforcement agents had been arrested before the recent incident.
State Rep. Tarah Toohil, R-Butler Township, said she discovered the man was charged with harassment by state police at Hazleton in 2008.
Three years ago, Oswaldo Tlalmis-Perez, 27, of West Hazleton, was cited for harassment after he allegedly struck a woman in the face, giving her a bloody lip, during an argument at Sixth and Spruce streets, according to state police. After being struck, the woman left her vehicle and asked a passing motorist to call police. Tlalmis-Perez allegedly left the scene before officers arrived but was later charged.
Toohil said she discovered the 2008 incident on the advice of a constituent.
"I've had more than 50 calls and emails about this case," said Toohil, who joined her colleague, state Rep. Doyle Heffley, R-Lower Towamensing Township, in Beaver Meadows last week to say they will challenge ICE on why Tlalmis-Perez was released. "Some of the calls I received were from outside the district."
When he was apprehended in Beaver Meadows earlier this month, Tlalmis-Perez, now 30, had in his possession two Access cards, which carry electronic food stamps used to buy food and other necessities.
"At first, the report said he had two Access cards from different states, but then I heard the cards were both from Pennsylvania, under different names," Toohil said. "He also had $3,000 in cash. But ICE said his case was not a high-priority case. But this is obviously not someone who is contributing to society."
In the days after the recent arrest, ICE Northeast Regional Communications Director Michael Gilhooly said "ICE has the pertinent information on the individual to follow up at a later time."
"As the subject was not arrested and charged with a crime by the local department, did not have a criminal record and is not a fugitive from ICE, the subject was not a priority case and a detainer was not placed," Gilhooly said.

This scum bag is walking around with $3000 grand in cash (more than I have in my bank account) with two Access cards for welfare secured under two different names. Never mind the fact that ICE refused to pick him up because this was not a “priority case.â€

Illegals almost NEVER are held by ICE unless the criminal matter is serious (Not even DUI) because the process to deport is so lengthy and time consuming. As it is, waiting for a deportation hearing takes months. In the mean time, you can make motions which delay the process.
