    posted June 29, 2006

An illegal immigrant has been arrested in the case in which a vehicle plowed into a house at 2805 45th St. in East Lake Tuesday morning and injured a 91-year-old woman.

Facing numerous charges is is Vitalina Bautista Vargas.

She is being charged with leaving the scene of an accident with injuries, driving without a license, no proof of insurance and reckless aggravated assault.

The victim, Louella Winton, remains hospitalized at Erlanger Medical Center in serious but stable condition.

She was reportedly in bed when the vehicle knocked her through the bedroom wall and threw her against the wall of the house next door. Chattanooga firefighters pulled her from the debris, and handed her over to paramedics with Hamilton County EMS, which transported her to Erlanger Medical Center.

Ms. Winton received some cuts and bruises.

Woman Charged with Vehicular Homicide in Court

In General Sessions court today, Judge David Bales pushed back a hearing for an illegal immigrant charged with vehicular homicide.

Vitalina Vargas crashed her SUV into the side of Lou-ella Winton's East Lake home on June 27th.

The 91-year-old Winton died a week later from injuries sustained in the crash.

Vargas' attorney, Johnny Houston, wants more time to work with prosecutors.

He says postponing the hearing now could save months of court time later.

"Odds are, she's probably going to be deported under any circumstance. But, we're looking for a way that perhaps that won't happen. But, we'd like to get the case resolved as quickly as possible and we don't want it to drag out," Houston explains.

Vargas returns to court August 7th.

Put her in jail for vehicular homicide and then deport her.
