    Illegal Immigrant Robs More Homes After Getting Released On New Bail Law

    An illegal immigrant in New Jersey managed to get arrested for burglary twice last week after forgetting his correction center intake papers in the second burgled home, leading to his arrest during an in-progress third burglary.

    Douglas Baudriz-Diaz was first arrested May 22 after a witness saw him break into a South Plainfield, N.J. home at 1:30 a.m. He arrived at Middlesex County Adult Corrections Center (MCACC) at 8:30 a.m., according to a press release posted on the South Plainfield Police Department Facebook page. Baudriz-Diaz was released without bail later that day due to a January Bail Reform Act passed in New Jersey.

    “With the old bail guidelines, he would have been held in the MCACC with a bail between $10,000-$50,000 due to the degree of his charges,” the police report said.

    Police called the illegal immigrant’s release “unfortunate.”

    Intended to lessen the strain on New Jersey’s prisons, the January bail law created a risk assessment tool to determine if a defendant is likely to either not appear for trial or commit another crime. Offenders deemed “not likely” are released. The assessment takes into account the offender’s age, past convictions and whether the offense was violent, among other factors. It doesn’t consider race or ethnicity, the Philadelphia Inquirer reports.

    The assessment apparently also ignores immigration status, as Baudriz-Diaz was being held on an Immigration and Customs Enforcement warrant due to being in the country illegally.

    Police said he is suspected of four other burglaries in the South Plainfield area.

    Illegal Alien Allegedly Burglarized Home after Release Without Bond

    Despite the presence of an immigration detainer, New Jersey police released an illegal alien with no bond after he allegedly burglarized a home in Middlesex County. One week later, local police arrested the illegal alien again while allegedly burglarizing another home. He is a prime suspect in another burglary that occurred on the day he was released from jail.

    U.S. Immigration and Customs Enforcement (ICE) Enforcement Removal Operations (ERO) officers issued an immigration detainer on Douglas Baudriz-Diaz, an illegal alien from El Salvador, after South Plainfield, New Jersey, police officers arrested him for burglarizing a home, according to the department’s Facebook post. A neighbor reportedly witnessed the break-in and called the police. Officers arrested him and processed him into the Middlesex County Adult Corrections Center at 8:30 a.m. on the morning of May 22. ICE officials issued an immigration hold because of the alien’s prior criminal history. Seven hours later, jail officials released the criminal alien without any bond, under the newly enacted New Jersey bond reform law.

    Later that same night, a homeowner reported his home had been broken into and items were stolen. Responding police officers found Middlesex County jail and Pre-Trial Release documents left behind in the home. The documents bore the suspect’s name, police stated.

    Police issued a warrant for his arrest. Before they could find the Salvadoran national, police in the neighboring North Plainfield received a call about a burglary in progress on May 29. Officers from that department arrested Baurdriz-Diaz during the alleged commission of the burglary.

    South Plainfield police stated the criminal alien is a suspect in four additional burglaries in their community.

    Breitbart Texas reached out to ICE officials who confirmed an immigration detainer had been placed on the suspect. Previous conversations with ICE officials confirmed that, with rare exceptions, an immigration detainer is an indication the suspect is illegally present in the country.

    ICE officials confirmed a court convicted the suspect in January 2017 on charges of criminal trespass. He paid a fine for that conviction. He has an outstanding charge from June 2016 for simple assault and three additional charges related to previous burglaries.
